They will use the words “Mediator”, “Arbitrator”, “Law Office” or claim that they are a “Lawyer or Paralegal” to make you believe that they are something other than a debt collector want-a-be and that they don’t have to follow Federal and State collection laws, even though they do have to follow those laws. They also tell you that if you fail to call them back you are "waiving your right to council" or that “the case will proceed without you” which is pretty much nothing but hogwash. They tell you that they need a “statement” from you regarding the complaint and if you don’t call back they “wish you good luck as things unfold”. They use the phrase “consider yourself notified/served” or “govern yourself accordingly” a lot, something they should do themselves.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

- CaliI received a phone message @ work. It rattled me. It was a message from a Sam Wallace regarding a formal complaint filed against me. And that I should contact the plaintiff for questions. He left a phone number 1-855-548-8896 I called the number. Someone answered and they did not identify the company or their name. They answered like they were at home. So I had my manager listen to the message. And he said it's clearly a scam. And he had me talk to our HR person. She listened to it. And she called the number. She asked for a Sam Wallace...long pause... then finally she was told he had left for the day. And I asked her, did they say who they were when they answered the phone? She said no.
Anyway, the at home I receive a letter trying to look like a legal document. It said I owed money $9k to who it did not say, but I need to pay the amount.
Anyway, I just thought I would share my Sam Wallace and Don Sterling encounters.
I looked into BigA's post and I'm in the process of filing a report.

- SueTHIS COMPANY IS DEFINITELY A FRAUD. I received a letter indicating a "litigation notice" for $2,228.72 that I owe and to pay in 10 days. I don't owe this money at all and I am bringing the letter they sent to my Attorney General's office tomorrow. THEY ARE A SCAM FOR SURE.

- BigA replies to CHRIS IDee posted here 2 years ago and unless you know she will be back, I would not wait for an answer. Putting your email address on an open website it simply begging for trouble. They cannot take your disability check, and they cannot legally simply double the bill. If they put that in writing you have an excellent FDCPA case. You should seek the advise of a consumer lawyer who will sue them on a contingency basis. Read the rest of the posts in this thread as well. Post reported for removal to protect you.
