    Called my cell.  Told me they were calling about a court in an unnamed county, action against me and if I didn't call Wendy Smith at 877-316-0096 to get it taken care of, I would be charged with failure to appear.   Claimed to try to serve papers but they didn't have the right address.  Yes, I moved over 20 years ago!

    I received the same call from this same Wendy for an unknown civil court case. She knew some private info, but I am sure it's from things that are found on the black market these days (everything gets hacked these days). I can tell she called different times and on different cell phones, but would never leave a voicemail. When someone finally picked up, this was the result. Wendy is speaking in English, but not very well. So this is suspected spam unless she can say what it's about. How can her company just not get a hold of anyone to serve a summons?

    That is a lie meant to try and instill enough concern in you that you would call these scammers back.
    "Failure to Appear" is a determination made by a Judge when someone does not appear in the courtroom at the scheduled time for hearing the case.  However, for someone to be required to appear in court at a specified time, a court hearing has to be scheduled and that hearing cannot be scheduled until after the defendant has been successfully served with a summons (the "legal documents"/"papers" mentioned in previous posts).  If "Wendy Smith" was a real attorney, she would know that and would not let someone in her law office to make such threats.

    This is a "Fake Process Server" scam which is often a lead-in for a "Fake Debt" scam.
    There are no letters, papers or documents andno court cases are going to be filed .

    The message they leave is intended to instill enough concern in the intended victim that they will return the call.  The goal of the scammers may be one or more of the following:
    • They may just be phishing for personal information, under the guise of verifying your identity, so they can use it for identity theft later.
    • They may claim that you need to pay "processing fees" before they can serve the papers.  Payment could be demanded through gift cards, cash transfer apps, or by requesting bank account information.
    • The scammers might use this as a pretext to a "Fake Debt Scam" and will claim that there is some outstanding "debt" that they are trying to collect on.  The claimed debt will usually be very old (beyond the Statute of Limitations) and a fairly sizeable sum.  They will offer to let their victim settle the debt for a fraction of that amount and avoid being sued in court if they pay then and there over the phone.  They will be very aggressive and try to browbeat and threaten the victim to make a payment.  They will refuse to give any details about the debt beyond generalizations and will also refuse to agree to send any documents supporting their claim, often claiming that they were already sent at some earlier time.

    Relatives of the intended victim and even employers (present and past) may be called in an effort to embarrass the victim into calling the scammers to get the calls to stop.

    The best course of action is to ignore the calls and not return any call.  If you have any doubts about being sued, call your local courthouse instead and have them check if anything has been filed against you, you will find the lack of results reassuring.
    Remember that if you were really being sued, a real process server would not call you or a relative about papers needing to be delivered, they simply show up and serve the papers.

    Same experience as described. Gave the same 877 number to return call but called from a Texas number, 210-879-4749. It said, like all the others, to call Wendy Smith. There were so many awkward pauses that it didn't seem real. I'm glad I searched that 877 number.
