Man Wins $1.5 Million After Receiving Racist Debt-Collection Calls

A debt-collection agency claimed that Allen Jones owed a meager $200 on a credit card bill, and they intended to collect it by any means necessary. Instead, it may end up costing them more than $1.5 million.
Over the course of a few months, Advanced Call Center Technologies of Dallas called Jones several times and left harassing and racist messages:
"This is your mother******* wake-up call you little lazy a** b****," WFAA reported a collector as saying in one message.
"Get your mother******* n****r ass up and go pick some mother******* cotton fields," said another collector.
The calls came at all times of the morning and night and allegedly included a sexual comment about Jones' wife. The worst part of the abuse is that Jones, who is African American, said he had paid the bill already.
"This shouldn't be tolerated. Nobody should have to experience what I had to experience," Jones said.
The messages made all the difference, said Mark Frenkel, one of Jones' attorneys. "If we did not have tapes, no one would ever believe that this happened."
A Dallas County jury awarded Jones $50,000 for mental anguish and $1.5 million in punitive damages, and he deserves every penny. Maybe the verdict will send a message to the abusive collection agencies out there that take advantage of people by threatening them or calling them so often that it amounts to psychological warfare.
Some debt collectors also lie about the ramifications of not paying a debt. In one such case, a woman committed suicide after being told that authorities had been contacted about the debt she owed. In another instance, a New Mexico man sued Verizon Wireless after a debt-collection agency threatened to blow up his house over a $308 bill.
The Fair Debt Collection Practices Act forbids some of these dirty practices, but some debt agencies still call family, friends and individuals' places of employment about their debts.
Unfortunately, some of these bottom-feeding agencies also tack on extra fees to the debts that may be owed. They also have a habit of harassing people for debts that have already been paid or can no longer legally be collected. According to the AP, the Federal Trade Commission receives more complaints about debt collectors than any other industry.
More legal protections need to be put in place to shield consumers from these greedy agencies. The way in which these agencies constantly sell the debt to other agencies should be limited, because it forces consumers to go through the process of disputing incorrect debts time and again.
Consumers also should understand their rights when it comes to debt collection. For example, you can stop the harassing calls by sending the agency a certified letter stating that you no longer wish to be contacted about the debt in question. You also have the right to dispute the debt and ask for proof that you actually owe the debt. Finally, consumers have the right to negotiate a settlement.
When it comes to debt collectors, and your finances in general, knowledge is truly power.

- JPMN replies to STOP BANK FRUADI just have a few things to say, I am bothered by the fact that it is some real live idiots posting on this sight wether you take out a payday loan, owe a debt to whomever it does not give you them the right to call your home and threaten you with warrents for your arrest and call your home day and night what attorney office you know works after 5-6 PM thats # 1 and how can they just assume that someone has committed fraud, I have been a victim of identity theft in the past granted that my credit is not all that great but it doesn't mean that people can't use your info in other ways. It's ludacris that some people can just say all you have to do it pay your bills, you never know what a persons situation is, I have been trying to research this company because I too have been contacted out of the blue I never taken out a payday loan and I informed him of that I also have requested that they send me more information regarding this matter so that I can contact this company he told me that he could fax it to me I don't have a fax send it to me in the mail and I'll get it taken care of with the company you claim I owed that was not good enough so I am not sure if this company is legit or not what's a person to do yes people should pay there bills if they rightfully owe them and sometimes people fall on hard times you never know but it's not excuse to threaten people, and I understand that collection companies have a job to do but dam for real if your just that legit why is it so hard to get them to give you information that should rightfully be entitled to.
- Pachacutec1First of all, many of the payday loan companies share their information with bottomfeeder collectors or other PDls who have NO connection with the person who borrowed the money and many times aren't even located in the United States, but they are using bogus US phone #s. They will call and use semi-legal jargon and official-sounding names to scare people into sending them money. If someone calls you with such a line, do NOT admit to owing a debt over the phone; tell them it is Federal law (and it is) that when a collection agency contacts you, they have a certain amount of time to send you something in writing about your (supposed) debt. I'm willing to bet you never, ever get a letter. And in any case, I wouldn't give anyone a nickle based solely on a telephone call!!
- kwi got a call yesterday from a guy at this lawyer place. he said i have a warrant (after calling my parents house!) and that i had to pay everything off otherwise i would go to jail for fraud. WRONG! after i gave him my info (bank card number, drivers license, and verified my social) he wanted to take my whole next paychecks he said that i owed like 2000 and some odd dollars. well i called the place my loan was through the gal was mad and told me that this is NOT true she stated that they NEVER use lawyers that they take people to court themselves. she also said they have been getting numerous calls regarding the exact same thing i was telling her. she also told me that there would never be a warrant issued becuase it is a civil matter not a criminal matter and that if there was any FRAUD it would be if i had used someone else's check when i took out the loan not my own which WAS NOT the case i used all my info to take the loan out no one elses. guess this guy is going to be pretty pissed when he finds out at the end of the week that i shut down my bank card. i also alerted all the credit bureus. the two companies i talked to said that this is absolutely for sure a scam. they try to freak you out (which i did) to get your identity and your money. if you get this call IGNORE them dont freak out if you do give out your info cancel your bank card alert the credit bureus, your local law enforcement and your attorney general. no one needs this crap in their life! they are just a bunch of scammers trying to do horrible things and ruin people lives. and not only that but i bet they wouldnt like it if the tables were turned and it was them in this situation.

- Very irritated!Hey both of you "honestly pay your debt you owe" AND "WHO"S TRICKING WHO"...think before you speak crap! Yes its is the responsibility of these people to pay the debts back. However, they do not have the right to cause anyone to commit suicide or mental anguish and threatening to put a warrant out for their arrest or any other sort of nasty threats. There ARE better ways to collect the damn money, going to those extremes will cause you a lawsuit! People DO have the right NOT to be harassed or threatened in such nasty manners! I bet if the shoe was on YOUR foot you would complain too! And those people who have taken out loans and couldn't pay them back?? Did you ever stop to think that something may have happened where they couldn't have paid it back and wanted to? Then never got a phone call or letter from the debt collector? - JeffGot a voice mail on my cell phone from a "Christy Harris" claiming to be calling from Bronstein. Shultz and Harris. She stated I was a person of interest in a fraud case and it was imperative that i return her call in the next 24hrs and then gave a case number. (like it was a court case number) I am not now nor have I ever been a "suspect in a fraud case . I will return their call to inform them that I'am filing a complaint with the Indiana Attorney General's office. Also some how they got my 89 year old grandmother's phone number and harressed her until she gave them my cell number.
