    I was told that he wanted to reach my daughter regarding serving papers on her for a debt from Utah on which her name and as # was listed and her name checked.  She never had any accounts in Utah and has nothing outstanding. She has good credit. I told him someone must have stolen her information. He said the debt was old and now $2687.61. And her credit was checked and he felt could afford to pay this debt!  If she paid it today, however, it could be settled for $687.21.  This is obviously a scam.

    One of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them and they can scare that person into paying their extortion money.  They often call people that have never even been associated with you because they get erroneous information off of the internet.

    Yes, it is a scam, and the law says this:

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid. 

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

    Most likely no one has stolen her information.  The scammer is using a robo-dialer looking for anyone dumb enough to fall for the scam.  Congratulations outsmarting him.

    I had the exact thing happen to me. They called my work, my family, it seemed like they went on my facebook and got info from there to get a hold of me any way they could. They are extremely threatening and reading my bogus disclosures. I work at a bank I know what one really sounds like. They even called me at 1am. I actually feel better that someone else is going through the same thing I am. I was getting a little worried and scared with how much they were harassing me. They claimed to be from California His name was Christopher Chambers from Madison Consulting Group something litigation firm. Screw them.

    Thus person calked me and my son at different numbers. We did not answer.
    He left a simikar message to both.
    Said he is Bill Chambers.
    He has a foreign accent.

    Asked for my brother to call (877)408-3268 saying that a charge may be filed against him.
    When people do a search, family names and numbers come up. Maybe that's how they get their information.
    It's a scare tactic scam.

    Received a call that came up as unknown, already suspicious when someone doesn't show their number. Then a message was left stating that a complaint might be filed against me with a DA # blah blah blah, and said his name is Bill Wise and I will need to call him up to settle this matter and if not, this could be filed. Also stated at the end this is the official notice that I was served and it's recorded.  You could tell he was reading from a script and trying to fill in spots with info that could pertain to me and he stuttered and such. He gets a "F" for his bad acting skills! I will report him and the number he left today! I recommend to others to do the same. When you do a search with the phone number, nothing creditable comes up! SCAMMER!

    Just received a voicemail for my brother, that it was regarding a pending complaint filed against him. She even gave a case number to reference and said her name was Nikki Kennedy. Sounded official but then ended it with saying the voicemail counts as him receiving notice, which is obviously not true when filing any litigation. She did know his full name and multiple counties/addresses he lived in. Looks like public records search, as he isn't even on facebook or anything like that.

    I had the same experience as "notme". A message was left for name that is not me, stating I needed to cal 877-408-3268 to settle "this matter". I called my state's attorney general and the federal trade commission to file a complaint.

    Got another call about a lawsuit about to be filed if I don't return the call. At the end of the call, they stated they would call my place of business, etc. First, I am retired; calling my employer would be laughable. Second, if a lawsuit is about to be filed, so what. Either a lawsuit is filed or not. If the company it is going to send out a DEMAND LETTER, well send the letter. However, threatening to file a lawsuit holds no weight. Anyone can 'file' a lawsuit the issue is whether the facts stated in the complaint is true, which requires an Answer, or if it is incomplete or does not adherre ot the law, my response would be to file a Demurrer and Motion to Strike (either the entire Complaint or portions of it). Threatening does but some poor souls get upset by the threats of these 'bottom feeders.'
