- Truth| 15 repliesDoes not comply with the requirements of the Federal Debt Collection Procedures Act.
Either you or someone who used you has a personal reference had a debt charged off by the lender or discharged in bankruptcy or mediation.. Some clowns bought the debt for pennies on the dollar and is trying to intimidate or humiliate someone into paying.- Caller: Fake Debt Collector
- Call type: Debt collector
- Ma replies to Truth| 13 repliesI just gone one too. Did you call back? Debating on what I should do.
- JasonJust got one also. Scammers.
- LoriThis is a number from a debt collector making treats.
- WolfmanJack replies to TruthOr the debt doesn't exist at all. And if "someone you used as a reference" owed money why would they be trying to collect off of you?
- WolfmanJack replies to Ma| 10 repliesIt is incumbent upon them to prove that the debt exists and that you owe it. Not the other way around.
This is a common ploy by criminals masquerading as debt collectors who are attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this, all for an alleged or nonexistent debt. One of the tricks they use is to call your work place, friends, or relatives repeatedly in an attempt to shame you into paying. They also use the “process server” ruse who calls and claims he is going to serve you, but then says you could avoid it by calling another number
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Read up on your rights here, get template letters to send and also make a complaint at this government site: http://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.
List of State AG’s offices: http://consumerfraudreporting.org/stateattorneygenerallist.php - David G replies to WolfmanJack| 9 repliesThey did not indicate in the recording that it was an attempt to collect a debt. Just said it's important to contact them regarding an important matter. Violation #1 - failure to identify.
Violation #2 - failure to engage me via email first. - MJG replies to David G| 1 replyEmail is NOT an official method of notification. That would be a LETTER that is MAILED giving details such as their company name & address, the original creditor's information, dates, amounts, etc.
- David G replies to MJGThat's what I meant.
They did not engage me. They sent a pre-recorded message with name and instructions to press 1 to verify I was that person. Nothing to the effect of "this call is from a debt collector, and any information obtained will be used for the purpose of collecting said debt"
They have no company online. Number goes back to a 'Dental Works' in Macedonia, OH: http://businessfinder.cleveland.com/dentalworks-macedonia-oh.html (shown on the left).
Which means the Dental Works business is being spoofed. Or went out of business. - WolfmanJack replies to David G| 6 repliesTechnically stating that it is an attempt to collect the debt on a recording could be construed as a violation of the FDCPA. They are not allowed to leave certain information, so simply stating the company name and phone number would stay within the boundaries set by law.
Violation #2 doesn't exist. There is nothing in the law that states they need to send you anything in the mail first. Certainly not by e mail which is not considered a vaiid form of communication in this matter, just as a fax is not either.
Try reading over my above post again as you clearly do not understand it.
Then read the actual FDCPA: https://www.ftc.gov/enforcement/rules/rulemak ... ctices-act-text - David G replies to WolfmanJack| 5 repliesI did read it.
They did NOT state their company name. Only the number and that they were trying to reach me for a debt. But nothing to the effect that they were trying to collect it, or even were licensed to do so. - Dewey| 5 repliesSo how do I get them to stop calling???? I work at a very strict business company and I don't want them calling my job
- Caller: UNK
- Call type: Debt collector
- WolfmanJack replies to David G| 4 repliesI would get into this with you, but you obviously have a preconceived notion of what the law actually says. There are few states that require debt collectors to be licensed as well. But you seem to know it all, so I wish you good luck.
- Dr. J| 3 repliesI got a call, they had old info on where I used to live, where I used bank and a email address I have not had for years. When I asked him to send me a letter with the information he said they did before and do not need to send anything. (I have never received anything from them either mail or email) I told him I owe nothing and will not pay anything he said they were going to exercise the contract. when I ask what does that mean he said he was not going into the legality's of it. Also said the people I supposedly owe money too was Titan I have NEVER done business with any company named Titan. He was rude and condensing no legit bill collector would act like that. I bet dollars to donuts I get a call back saying there gonna send the police to arrest me.
- Call type: Debt collector
- Dee replies to Ma| 1 replyJust received a call from this number. No message left, so I called them back 45 minutes after they called. When they tried to identify themselves, it was very jumbled so you couldn't make out a name. The only thing I was able to make out on their recorded message was the word "recovery" and if you know your party's extension.
- Dee replies to Dee1-877-471-4349 is not a valid number. If you are sure that you got a phone call from a number beginning with this prefix, the caller may have 'spoofed' caller ID.
- VrydeI just got a call from that number and they left a voicemail of a pre-recording: This message is regarding our tracing and location efforts for *my name*; hit 0 now to be transferred to a representative, or call 877-471-4349; it is important that we speak to you about their whereabouts; if we cannot verify this information through you, the law allows us to contact all references on file. Even if you are unable to provide us any information, call us regardless at 877-471-4349.
- Vryde replies to Dr. J| 2 repliesDid you get the name of the debt collectors company?
- CWG40 replies to Dewey| 1 replyAbout all you can do is have the business owner tell them to stop calling. If they don't, report them to the FTC. Problem is, who, exactly are they. If you call that number they ID themselves as FMR.

! THERE IS AN ALERT ON FMR !
Collection agencies are required to be licensed or bonded in many states in order to operate and contact consumers about outstanding debts. BBB has reached out to this business requesting that they provide proof of licensing and bonding required for operating everywhere they do business. However they have failed to provide all of the requested information from our inquiries.
BBB wants to make consumers aware that they have legal rights when they are contacted by a collection agency. The Fair Debt Collection Practices Act (FDCPA) prohibits abusive and harassing behavior by any debt or collection agency, this act is enforced by the Federal Trade Commission, FTC. The act states specific practices and rules under which debt collectors must abide by. There are penalties for agencies found breaking these laws. Collection agencies must not use crude or offensive language or identify themselves as anyone other the business name that they are contacting on behalf of. If a consumer believes a debt or collection agency has violated any of the FDCPA laws the BBB encourages them to file complaints with the BBB at www.bbb.org and Federal Trade Commission at www.ftc.gov.
