Bill Price from JD Enterprises keeps calling our home and asking for a person that does not live here and never did.  We tell him that he has the wrong number and he still calls.  He's now leaving voice mail message saying, "Person's name, what part of call me back don't you understand?"  He is being rude and aggressive.

Back in Jan 2010 I was at lunch and I received an unknown call and it was Robert Brock telling me that he is heading my way the following day to serve me with some papers. He said that I am pretty out of his way and thought he would give me a heads up in case I wanted to take care of this so he didnt have to drive all the way here. He gave me the number of the company who was issuing the paperwork (JD Enterprise) adn to talk to Joe Willis. I was so frantic and not sure what I should do or who they are that I called them asking what this was in regards to. I spoke to guy named Brian James who was unimaginably rude. He said that I owe 1400 and in order to stop the carrier the next day I had to give him 800! I said this is the first that I am hearing about this and I have no idea what your talking about. He never said what it was for or when it was issued. He kept going how I am irresponsible and I am committing fraud and was going to go to jail and on and on for at least a good 20min. I finally broke down into tears asking him to send me documents of the invoice and he refused to. He finally said that it was for a pay day loan or something and that they deposited money into my account in 2007???? He bullied me and harassed me and broke me down until I gave him 400 bucks telling him I would give him the rest in a few days. After hanging up the phone with him, I started to do some research, thinking that I do not recall any pay day loans. Lucky for me I have online banking and looked through every month statements for any deposits made going back to 2006 and found nothing. Feeling sooo stupid that I cried like a baby because I was scared and not knowing what to do. I felt like a victim of a scam. I immediately called my bank and made a dispute for the 400.00. The bank did some research and FINALLY credited my 400.00 back. A few short days later I received a call at my office from a Mr.Ross yelling at me very angry because I refunded the money and if I wanted proof he will show me the proof in court. I finally spoke up and told him to F%&K off and not to contact me with out sending me proof. I told him that I would go to court if that's what he wishes to do but all I was asking for is a simple detailed information on the claim against me and if he would rather go to court then send me simple paperwork that I am entitled to then fine but he will not get anymore money out of me. A few days later  sent a very long detailed letter to JD asking for information and validation on the case and NOT to contact me by telephone and only by mail. I also mentioned that I am not refusing to pay but is asking for proof of the debt. I never received a response and he has not contacted me by phone or mail. I never saw any proof. I just received a voice mail 2 days ago at my office not on my phone from Mr.Ross asking me to give him a call (and again he was very rude). I have yet to return his call. I am sending out another letter to that company today.

Does anyone have any advise on how to handle this?

This company called me too. About an unpaid credit card bill that is over 10 years old. They yelled and threatened. Told me a process server was on the way to serve me with court papers. Said they knew I was making my car payments on time and that they were going to take my car. Funny, when they mentioned they knew I was making car payments, didn't they realize that meant I don't own the car? I explained that I am currently unemployed: what a shock in California's economy. He kept throwing lower and lower figures out trying to get me to pay him anything. I told the guy I can't give him apples out of an empty barrel. The he starts in telling me to ask my family and friends for help. I finally got the guy off the phone, but not before he continued to yell and threaten. Since they are a third party collection agency, the next time they call I'll tell them not to call back. At that point they have to cease.

I just recieved a phone call from a restricted caller saying that if I wanted to avoid being sommoned to court that I call Kevin Ross at 877-495-3328. I have no clue what it is over and they said that it was sealed and they didn't know what it was about. They also had some addresses for me in California. I haven't lived there since 2004. He also gave me a case number. WIERD! You have a great idea for requesting all information to be mailed! Thanks!

I also received a call from a Willis that his firm was looking to serve me notice to appear in court. I called the firm and spoke to Brian James who was convinced that the AT&T Wireless bill was probably not mine since I had never lived in the state where the number was set up and the fact that my current carrier is AT&T. Regardless, he the outstanding amount was $1,200 and that I should consider settling it for $400 as a nuisance value since I had a job and could afford it. I asked for proof that his firm owned the debt and for a copy of the original statement from AT&T. He said he would e-mail it, but I have never received it. I stated that perhaps going to court would be a way that I could finally get a copy of the outstanding will and prove that it was not mine. Mr. James said that since I had not responded in 30 days to a notice sent to me six year ago, that the claim had been validated and the court would grant them an immediate judgement; no due process would be provided for. Mr. James said that notice was not sent registered mail/return receipt so he had no idea of whether or not I received it, but that was not necessary. The claim was valid.

I did some checking on line and found that not responding to the original notice within 30 days was not admission of acceptance or validation. Additionally, there appears to be a four year statute of limitation so if they don't file suit in four years, the claim is dead. One other suggestion the on-line article had was to file suit in small claims court against the collection company to have the claim annulled and removed from my credit report. I think that is probably the best strategy, strike first and get them to cease their annoying calls.

SCAM. Just heard a voicemail from yesterday (7/7/10) from "Kevin Ross" looking for someone in my family. He said he's a legal administrator. He reference my family member by name and said in a firm and "official" tone that "this was an important call..." and left his direct line (a 562 L.A. area code) and a case number.

DON'T try to be clever by calling them back with another personal number (cell, work, friend, relatives). They will store that in their caller ID.  It's more fodder for their harrassment tactics.

Someone called another family member yesterday (not sure if the same person) and said he knew his address and warned him he'd show up and serve him papers for that person for some unknown reason, who doesn't even live there.  Sounded like bullying.

I did some checking yesterday online, and it seems that process servers never call.  They just serve papers.  If there's an issue, you can check your court to see if a legal claim has been filed against you.

In my case, I am angry.  I know they are SCAMMERS because the family member in question has zero debt and doesn't use credit cards.  A clean record.

NEVER send money to anyone you only spoke to over the phone, no matter how legit, nice or mean they seem.  If they have your information, like they say, then have them mail you the summons or collection request.  DO NOT provide your mailing address.  Again, if they have all your information, like they say they do, they will tell you what the address is to confirm.

By federal law, everything needs to be mailed.  Process servers MUST serve you in person. Depending on the state or country, some jurisdictions may allow a drop off.  In either case, they must come to YOU.

Let them come if they say that's what they are going to do. I'm sick of these SCAMMERS preying on people.  It's time we do something about it.  Call your state legislators and lodge a complaint at your district office.  Write a letter.  It only takes one to move the needle.  I used to work in the political arena and have worked with local, state and federal offices.  They have district reps. and interns who must log all calls and letters.

Also lodge a complaint with your Dept. of Consumer Affairs, phone company (get them blocked), Attorney General's office, Better Business Bureau and anywhere else.  You can Google it.

If they say they are an outside collection agency (versus a company's in-house business office), then they should be mailing you a letter with the company's information professional printed on their envelope.  They typically will mail you several letters in an attempt to collect a debt for a specific company.  Possibly also multiple follow up calls, always left in a professional manner.  They may attempt to collect via phone with a credit card.  In all cases, the company clearly identifies themselves.  If you want to verify whether the collection agency is legit, you can always call the place you owe to see if they have contracted with the third-party agency.  Talk to their business office or accountant.  Or, settle directly with the original place of business.

    Take heart and good luck!

Received a call my son answered and two call backs one with a message as I was outside at the time of the calls. A Dick Turpen represented himself as a representative of Advanced Attorney Services and that he would be on his way within an hour to my home. There was no case number, no reference to anything other than to this Willis character. I recently had heart attack and this has done me no good. I am glad to hear however that I am not alone with this.

My mother got a call from a private call. She answered it and was told these people were trying to serve me a supoena but they wanted to save me money if I would talk to a Mr. White. The guy that was talking to her was a Mr. Ross. Otherwise I would be stuck with court costs. It had it checked out and there are no cases against me in my state.  I have no idea what this is about. I felt it was more than suspicious and so did my mother. I just want these types of calls to stop and they dont need to be calling my 84 year old mother that is in poor health.

Received multiple blocked calls today on my cell. Answered one from someone saying they were calling from a legal service hired to send an officer to serve me on a civil suit filed by a Joe Willis against me. Gave some references to my addresses and work address so I began to wonder if it was legitimate. Asked me to call Kevin Ross at 866 220 5225. Tried to find out if any other complaints for fraud or scam where out there online before calling. Later in the day received a call at work from Kevin Ross- very abrupt, rude and annoyed that I request he not contact me at my workplace and to please contact me outside of work. He became angry and said "Ok then we will just send an officer over!" Even though it does seem to be scam or maybe even a collection tactic thats obviously stepping over the line, its still a bit scary and extrememly upsetting. Difficult to continue working without being rattled and distracted. Hope that any company actually trying to collect a real debt is aware of what these people are doing, I can imagine it can go on very long before someone holds them accountable and they are forced to pursue debts in a better manner. Will try and find an agency to assist me in contacting them to establish if its actually something to be concerned with or an actual scam. Couldnt get anyone to give me particulars on why I am being pursued at all.
