- BigA replies to TorranceThis is a common ploy by criminals masquerading as debt collectors who are attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this, all for an alleged or nonexistent debt. One of the tricks they use is to call your work place, friends, or relatives repeatedly in an attempt to shame you into paying. They also use the “process server” ruse who calls and claims he is going to serve you, but then says you could avoid it by calling another number
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Dominic Harper said he worked for Nationwide Processor Services and wanted to know if I was prepared for my court hearing. I asked what this was pertaining to and he said he mailed serving papers to my home to appear in court 30 days upon receipt. (ahahahahaha) I said, papers are served in person and certainly not mailed and the court date is not random. Ahahahah... I asked for his phone number and he said he was not required to do so b/c he is a process server. He gave me a number of AL& Associates.. 877-554-8569 with a reference number. I called that number and b4 I even had the 5 digit number out of my mouth a guy said is this (my name) and transfered call to a women who then wanted my S.S# b4 she could tell me anything. I laughed and she said there will be a bench warrant if I don't appear and good luck with that. She hung up on me without saying goodbye :'(
- SamanthaReceived a call from Ralph about a debt that I owed and that they have a file that has a judgment against me. To top it off they called my job. So I called back and they bounced me around until I got ALEX. I told him I would settle the debt and then he puts me on hold for like maybe a minute then comes back and said he spoke with the creditor. I was like just now. You took like two seconds (little bit longer then that). Then he says they want to know how I'm going to pay. I told him to send me a letter in the mail and I'll have to look it over. Then he gets upset and said I interrupted him. I told him I'm asking for your name and company info. I said by law you have 5 days from the time you contact me to send me the information. So he gets mad. I told him I will be reporting him to the police and thats when he hangs up. He never once said this is a temp to collected and debt or that the call was being recorded. These people find your information and try to get your money. Please be careful.
