    Said I have failed to pay a bill from Southwest Hospital in 2002. But they don't know where the hospital is because of HIPAA regulations. Refused to send an email with company information to verify the bill without first agreeing to a payment plan of $250 a month. Said they are a legal documentor for nelnet collections.

    Kim Brown from NAS called me from unknown number  and left message to call back to 8775639913- and when I called the debt is from 1999 and said I owe 1500.00. If I don’t pay or make payment agreement for 250.00 a month, or pay 1000.00 today, they will sent to my jurisdiction and then I will owe 6200.00. They cannot tell me exactly what the debt is for and will not send me anything until I pay or make agreement and pay first installment. I feel this is scam.

    You are correct. It IS a scam. A real debt collector will mail you proof of the debt - along with proof they're legally entitled to collect it. Phone calls, emails, faxes, & texts are not legal methods of debt validation.

    No one can sue you for a 21 year old debt.  Not even the IRS.  If they cannot tell you what this debt is then how are they going to prove that you owe it in court?  This is nothing more then an extortion attempt.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
