- Tj replies to Tra| 5 repliesIt's a debt collector trying to collect a debt that is past the statue of limitations. If you call them back and admit you owe the debt, the debt again becomes valid.
- KC replies to Tra| 3 repliesIt is a scam. I received a call saying there's a judgment against me for nonpayment from Aaron's furniture store. I've never bought anything there. I called Aaron's to see if maybe someone used my name but in fact they said they have no record of anything. But yet this scammer had my date of birth and social.

- CWG40 replies to KC| 2 repliesYou can check this out by simply going down to your local main civil court and checking the defendant's civil list. The clerks are usually familiar with these scams and will be glad to help out.

Orally confirming that a debt may be owed does NOT re-set the Statutes of Limitations on that debt. The only people that try to perpetuate that old myth are the uneducated & the scum that work for Junk Debt Buyers & Bogus Debt Collectors!

Gunnar - amy replies to Gunnar| 2 repliesI had someone call and say they were collecting on behalf of a bank that I had an account with over 6 years ago. Stated if I didn't pay something before the call was over that they'd garnish my wages...I made a payment...does that mean the debt is reopened? I sure hope not. I don't even have the money to pay it. I'm a single mother and barely make ends meet now!

"Only by actually making a payment on a time barred debt will that debt be re-validated."
Therefore, if the collector really held your debt, and if you made a payment, you restarted the clock!
1) A collector canNOT garnish your wages, without a court order
2) Collectors canNOT sue you in court, if the statute of limitations in your state had expired
3) BUT, if you made a payment after the SOL expired, the clock restarts.
Sorry to be the bearer of bad news. - BigA replies to amyIf it was past the SOL then yes you reset the clock. Now the problem is that you paid without making them validate the debt which means that they might have made the whole thing up. The even worse news is that you are now considered an easy mark and will get many more calls about this or other nonexistent debt both from these crooks and from the crooks they sell your name to. The first thing you need to do is to contact your bank and put in a fraud dispute on that payment. Make a police report if need be. The second thing you need to do is to actually educate yourself on how not to be a victim of this type crime.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

They use an address that is located in a shopping mall, some place called Annex Postal. Fishy from the start. I tracked down info on their webpage and its only 45 days old and only valid for a year. Still fishy.
Then I looked them up on BBB and the manager they have listed passed away in 2012. This whole thing is a scam. Do not give into them and research much as possible. I have caught people like this in the past. I tracked down one guy and was able to get his mother's phone number. I called her and she gave me his personal phone number. I called him and let him know that I would call the law on him if his people called me again and I never heard from them again.- Caller: Trident Consulting Firm

- MJG replies to DUKE MCGREGOR| 2 repliesPostal Annex is like the UPS stores. They, among other things, RENT mailboxes so there is a physical address. Many times you will see the address plus Suite ## to make it look like they have a real physical location.

They go by Trident Consulting and you if look on line, an identical matching website for Trinity Counsel, both In California. They use multiple contact phone numbers to throw off people trying to track their number. They called my elderly father and upset him by telling him I had a "complaint being filed against me". The FTC needs to go after these dirt bags.
