    They called my Sister in laws grandmother!  They said they were sueing me for a debt that was from 10 years ago! They dont have any of my current information. I have been at the same job for 6 years now, Im sure they could have found that out! I think its a collection agency!!

    They called my parents house stating that I had 4 hours to call and appear in court, but would not provide any information as to why I need to appear in court or what court. Found out they are a company called RINCON MANAGEMENT...scam artists from CA.

    To all those that seek legal advice here are some articles that may educate concern parties that owe a debt to a creditor. Seek legal counsel instead of believing these reports that have no merit. My understanding is this, if you know you  have an outstanding balance to a creditor whether it may be a bank, secured loan, internet/cable/cell/phone bills, or department stores. The debt does not go away you sign a binding contract.

    Recording Phone Calls and Conversations

    If you plan to record telephone calls or in-person conversations (including by recording video that captures sound), you should be aware that there are federal and state wiretapping laws that may limit your ability to do so. These laws not only expose you to the risk of criminal prosecution, but also potentially give an injured party a civil claim for money damages against you. According to California Penal code section 632. A violation of Penal Code § 632 can lead to a fine of up to $2,500 and/or imprisonment for up to a year. In addition, the violator may be subject to civil liability in the amount of $3,000 or three times the amount of any actual damages sustained as a result

    We just got a similar call. Called back and was told process server would be here within two hours. Told the man to let him come, we are not the person they are supposedly looking for. Now waiting to see if anyone does show up. No one on here has said if anyone does show up. Guess we'll find out.

    Just got like the 5th call from these people today. This debt is for my husband from YEARS ago!! I asked his name, and like all of you he said his name was Mike Davis and that he was a process server and that he wanted to know if anyone would be home to serve my husband papers. I ask EVERYTIME what for and they will never tell me what it's about. He just wants to give me the case number then a phone number to the damn rude Rincon Filling people.

    I don't know why I don't hang up, but I think I have more fun pissing them off then anything, because I feel like, if you are calling MY PHONE and I am his WIFE then I have EVERY RIGHT to know what he supposedly owes you guys. Am I wrong?

    I help people out of credit card debt everyday, this company called Rincon management is a collection agency they can not arrest you or send you to court, when they say that theyre breaking the law. You can notify your local attorney general and file a complaint they will FINE them heavly for using that tactic, it also opens the door for you to SUE them for the harrassment. And depending on your state law as long as you tell them upfront you record your phonecalls it is legal. Always look up your rights as a consumer..these companies are held by law under the FDCPA

    "Mike Davis" just called. Two attempts. First attempt I just ignored. Second attempt he left a message. said he was a "process server" and that "they" made numerous attempts to serve me papers ( which is a lie because I am *always* home. Then he went on to say that "they" would only make two more attempts before something he would not explain would happen; & that I should call him; & then he gave the phone number and the "case" number. Just another sleasebag collection agency trying to misrepresent themselves by using intimidation. Caller ID is the best thing that ever happened to the common man.

In most states the defendant will have between 20 and 30 days to respond, but you should read the complaint to get information about what your exact timeline is. If you do not respond to the complaint in time, the creditor can obtain a default judgment against you, which, depending on your state, can be used to garnish your wages, put a lien on your property, and/or levy your bank account(s). Typically you will have to pay a filing fee in order to file an answer to the complain

    No they can not communicate with you as his spouse unless he have given them permission. As per:
    15 U.S.C. § 1692c. Communication in connection with debt collection

    (a) Communication with the consumer generally
    Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt.

    (b) Communication with third parties
    Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not

    Check your credit report however, not all creditors or financial institutes report to all three credit bureaus. Don't ignore the attempts they are trying to reach at least contact the agency. An elderly person may have not heard the correct information and in may have not disclosed all the details and mislead you.

    Then they should NOT contact anyone other than that of the supposed debt holder!!!! Not only that, but these people can call all they want and, as I said before, they are not getting a DIME!! Oh and I will continue to harass them back if they continue to call my damn cell phone. I may even do as one of the other posters said and start recording my phone calls, and turn the tables on them. This is pure harassment and needs to stop!!
