    Read this carefully, or get somebody to read it for you.

    A phone call from a supposed debt collector is not legally sufficient evidence of debt.

    The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    * Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]

    Source:
    https://www.consumer.ftc.gov/articles/0149-debt-collection

    Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.

    IF you wish to communicate with the supposed collector / creditor, visit  the following page, for example "Action Letters" to snailmail:
    http://www.consumerfinance.gov/blog/debtcollection/

    If you KNOW you owe no money, or believe the call was from a fake debt collector, please take the time to read this:

    Rubbish......

    The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

    •is seeking payment on a debt for a loan you do not recognize;
    •refuses to give you a mailing address or phone number;
    •asks you for personal financial or sensitive information; or
    •exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

    If you think that a caller may be a fake debt collector:

    •Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
    If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

    •Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

    •Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

    •Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

    •Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

    I've received two calls from a Richard Goldman from 1 877-720-3009.  I called back and received a VM from Mr. Burns.  I've committed an IBC offense and they need a statement from for the attorney, to determine my intent.  If I don't call them within "probably" 72 hours they will contact all parties involved and proceed with a deposition.  He sounds legit, despite the fact that I know full well he is scamming.  I do plan to call him back or pick up if I'm able the next time he calls.  I would like to communicate to this fool that until I receive a validation notice that I could not care less what he has to say.

    My sister recieved a call threathening her
    Description of Complaint:
    My sister received a call saying they need to speak to me directly, I don't have my sister number, I haven't had since 2007. My mother which whom works for a debt collector attorney, did a reverse number look up and she even stated this is a scam. They make them selve feel powerful and try to manipulate people into settling a DEBT . I ended up calling and 2 things I noticed, they never announced the call was being recorded for quality and they did not read the disclaimer that they are supposed to read, they just immediate went into their PITCH and when it was NOT going anywhere they threatened law enforcement and hung up when I called back, they HUNG up on me a total of 3 times. My mother advised me to call them and tell them NOT to threathen my sister, so that is ONLY reason I was calling. I dont have my sister number so how they have it is beyond me, when I asked them for proof of debt they emailed me their portion of what they say is owed and I asked for the original contract, and they mysteriously don't have it,all they have is their letter, which any one person can make something on a computer saying they owe it, but without physical proof of actually evidence, they have nothing.

    OMG the same guy called me. He is very rude and aggressive. He said that if I didn't pay that I will be served papers at the address I lived as a child. He demanded I give him a credit or debit card number for payment, I could not send a payment in. I thought that was weird.

    They are called National Mediation Service, out of Amherst, NY. I got 4 calls from them containing illegal threats of warrants, arrest, and more. The. They called my extended friends and family and gave out confidential info to them and I didn't provide any of the names or numbers they called. I filed a complaint with the Consumer Financial Protection Bureau and the Federal Trade Commission. I have also secured an attorney and will be taking them to court for harassment. The best part is that I have all their messages they left me with the illegal threats. They are going down.
