getting texts from 208-428-5210 saying legal action is forthcoming since no response to prior contact requests and to call this 877 number.  No company name, no account identified. Assuming spam.  Will not call back.

The fake process server/location specialist scam usually contains:

They mention that they have received a Fax document or that some sort of complaint has “come across my desk” and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and have to be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.

They text me with a claim that I had an unpaid balance and that they needed to seek legal action . I called the number . It was some supposed law fort called hart law firm . I was given information pertaining to a medical bill from a hospital that closed years ago . And they couldn’t give me any other information . So I called so many places to see if the bill was legitimate . The bill isn’t at all . There’s no bill in my name in any of the hospital accounts. The woman from the “ law firm” said that she wasn’t able to give me any more info however she would call me back . They knew way too much information of my personal identification for me to be comfortable with .

This number keeps leaving me texts, they also will text from a local number also, saying I owe money from a CC from 20yrs ago and that if not paid they will send to a lawyer and take legal action.SCAM

Texted despite prior contact there is no resolve.there is no other choice than legal action. Have my name correct no other info. Multiple times this week. I keep blocking them

Got text from number +1 (701) 638-7566 about legal issues and to call them back at 877-770-5901, also said to text stop to unsubscribe so I did and received a return texts says Empire Merchant Solutions LLC will no longer send me texts, googles the company there is one website for it but no information as to what kind off company it is and the numbers and email address in the website don’t match any of the numbers or emails that contacted me. So I called the 701 number and it was an automated message saying if I received texts from this number to replay stop to the text and it will stop but that the number is only used for texts at this time. So I called the 877 number didn’t tell me name of company just said associate department, said I got contacted from somewhere there, they “looked up” my info and then transferred me to someone else didn’t catch what department he said he was in but once again had to tell him I received a text to call back this number….asked if I received legal papers, said I have not, then said I can get those draw up and asked if it was me but used my maiden name, stated was not and he said he would get the number 7343 removed. Never told me a company name or their name or what it was about and was not giving out my personal information to people I know are a scam.

I am blocking them. If I owe a debt, you'll send me a notice in the mail like they are legally required to do.
