- interruptedThey claim to be "civil arbitrators department', claiming that is company name. Could only talk to one person and is high pressure collection agency, apparently sending someone out to 'serve' me something or other to testify in court, against character of someone who used me as a reference on something I had no knowledge about. Told me if she called them, they could remove me from list, however, when she did, they said unless she paid them $x would not stop anything, so they are calling my home, my WORK cell phone and threatenign to show up at MY JOB to serve ME on a debt SHE didnt pay and just listed me as a reference. Additionally, can serve me, but said unable to tell me what it is about.... EVEN went so far to tell me I should do better picking friends, I was livid at this point, who has any control how ANYONE uses them as a reference? I didnt know, I didnt' give permission, how could I possibly have prevented this??? They said they put a stop order in to not come serve me, but aggressive, "hands tied", "already in works" and harrassing!!! and those calling to 'serve' me papers refuse to give anythign but their name, so no way to get back to them....

- CISame thing happened here. They were looking for my mother saying that had papers to serve on her. I'm a lawyer and I know that process servers DO NOT call you in advance. These are not real process servers this is just a scam to scare the person into calling them back and then they try to shake that person down for money. To everyone going through this...IT IS ILLEGAL. These debt collectors cannot collect debts this way. If you find yourself in this situation just hang up. If they want you to pay ask for something in writing. Ask them to investigate the alleged debt for fraud before they collect. Do not give in to their threats. If they do try to sue them. Be sure to let the court know about the harrassing phone calls. The fact that they pretend to be law enforcement and that they threaten criminal charges. All of this is illegal and they can be fined and taken out of business. Also in states such as Texas they must be bonded in the state to collect debt. Good Luck.

- DeeIn my case they faxed a letter for verification of employment to my work fax, only the heading of the fax cover said civil arbitration department no company name, and stated that the HR person write my salary and that it's important they give the fax to me to sign and fax it back to them or contact them at this number listed- I guess once I saw that it was suppose to scare me into calling them. Prior to that these people contacted my Dad stating they were going to sue him because I used him as a reference which is a complete lie I have never used him as a reference, and even if I did- since when do they sue references??? I thought it was only co-signers that risk a collector coming after them if the person they're helping doesn't pay. I believe this to be an old payday loan and on the application they ask for a few relatives not living with you in the event that they can't reach you-which is how they probably had my Dad's number, and since I have moved twice and changed numbers they probably couldn't reach me. I was making payments but could no longer afford to once my husband was laid off and I was on disability. Prior to the fax ; When they contacted me at work, I didn't disupte it I told them this could more than likely be my debt but to send verification of the debt i.e original creditor information, as well as the previous amounts paid, the balance etc through the mail- I gave them my address and new home and cell phone number and said I would send a cashier's check in two installments to pay off the balance. They refused to send anything through the mail and requested payment over the phone via credit card or bank. I told them they could be anyone pretending to be a collector to which they said "well we have your personal information" to which I said "any decent hacker can obtain that." since I was desperate and stupid enough to apply for a payday loan, they could have accessed my info on line. Furthermore I have the right to request proof of the debt in writing espescially since I previously made payments. I would like to see what you have on record. They said since this was a loan processed across state lines it's considered a felony and a warrant could be issued for my arrest. I told them wow a warrant for my arrest? sounds serious I'll have to contact my lawyer as well as the local sherriff and just surrender (lol). I was then placed on hold. Then they came back and offered a settlement of 50% of what I supposedly owed I still said fine, please send me a letter with that offer so I have proof that this was the agreed offer and I'll send the full amount so the account can be settled. To which he said we'll send an e-mail and an official letter that should arrive in 7-10 business days but will need a credit card to secure the offer. I said okay you need promise that this settlement offer will be honored? okay but the card can't be run until 10 days from now since I don't have the letter...On a side note my hubby sometimes falls for these so-called great offers that require a credit card so I had him get a green dot prepaid card that way if the great offer claims they only charge 9.95 then that's all he loads on there....ofcourse later he gets notification from the so-called great offer that an additional charge for $59.95 was declined....but that protects our real cc from these kind of scams, anyway so I gave these people that card number , they said they would charge it in 10 days, around the same time I was to receive the confirmed letter. The e-mail letter confirming the offer was to go out that day ....let's see that was in early November and it's January now still no letter or even an e-mail, just the fax (aka most recent scare tactic)...Also they noted a legal case number seriers of numbers ending in CV. I checked the legal database in their area as well as mine and nationally and the number does not exist. What I will do is report them for illegal practices and contact the original creditor to send proof of the debt. We've been working on clearing our debt now that we're finally back on our feet, but no way I'll be threatened and strong-armed into paying something without proof. Hope that helps anyone else going through the same thing- don't be alarmed or scared into giving payment information without proof of the debt in writing, these folks can appear to be scary if you don't know your rights....Also any additional tips or further suggestions for me are welcome as well. Thanks

Payday loan collectors, typical Buffalo, NY style of threats, with no paperwork. No license or bond found anywhere we checked.
Stay far away from this liar and apparent extortionist, he likely won't last long. Again, they are NOT a law firm. His name & website appear to have been designed to deliberately give a false impression, when he is nothing more than just another debt collection con artist.
From an email:
"Been contacted by a "law firm" of Davis & Clark out of Amherst NY (web site = www.davisclarkinc.com ). They are stating they have "papers" to serve on me, but will not give me any further info."
From his website:
"Where we differ from collection agencies, we employ a brokerage business model consisting of Attorney Collectors, Top Commercial Collectors, and Private Investigators. This is why we are prepared to seek out and exploit every opportunity we have to help you."

- Dee replies to Information PleaseThanks this is good to know, it's amazing the lengths these crooks will go to. Calling someone telling them they plan to serve them is just ridiculous with a legitimate suit no one calls to let you know you're about to be served. With my story just before yours they even threatened to arrest me lol....
- LucyI received a call from Davis, Oliver and Clark today. The gentleman who called me said he was from the Arbitration department and the person of interest they are looking for gave them my name as an emergency contact. They wanted me to call them immediately. These people should be reported to the Attorney General's Office.
They called from 1-877-913-5377.- Caller: Davis, Oliver and Clark
- Spike replies to Information PleaseWhat's ironic is payday loans are illegal in New York. Hopefully these [***] clowns won't last long and be shut down ASAP!!
- 855-833-5296"Jeff Spears" said he was going to come and serve me today to appear in court, this is a fraudulent company. I called them back several times and when I let them know that I have information saying they are a fraudulent company the hang up. I then called and was hung up on every time, they would not even answer they would just disconnect the call. This actually became a game calling from different numbers. They will tell you you owe money and say they are going to have you appear in court. They will try toget you to pay some amount of money to keep you from going to court.***SCAM***SCAM***SCAM***

- KatherineReceived a call from Jack Roberts, Arbritrators Office, 866-676-4907 claiming my ssn had been used to open a bank account, the person then took out a $1000.00 payday loan on that checking account (which was not in my name) he said he was having a warrant issued for me in the county I live in. I asked for an address and website to verify his company, he said they didn't have a website and that he was in New York. He was willing to settle the account for $500.00 and send me all the file information so that I could take legal avenues to recover my pay off. Thing about it is, I didn't know who I was going to be giving MY bank account information to, as mentioned in some of these other posts, it was ALL very high pressure, so I guess I might be going to jail for something I had nothing to do with. I have already reported all the information to the local police department.
