- Umi| 9 repliesA man calling himself "Jeffrey" called my number. He claimed that he had my address and was coming to "serve me with sealed documents" tomorrow between 12 noon and 3pm". The call was recorded and when I looked up the number, it came up as having many different locations. The last name he used for me was one I had used way back in my Army days over 20 years ago and have not used it since.

The fake process server/location finder extortion SCAM usually consists of the following:
They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency. They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer). They threaten to serve you at home or at work. They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work. They also tell you that you will need two forms of ID. None of which is true. Process servers do not ever call ahead so that you can dodge them. Process servers get paid to serve papers, nothing else. They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”. Court documents are time sensitive and must be served within a certain amount of time. Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

My phone never rang, it went straight to voice mail and the message was transcribed like this: “Name 877-871-3534 how you doing today is Jeffrey on the private _ _ area give me a call here today in regards to seal documents that require your signature because USPS has healed _ no results for the file _ party so they hired me to hand deliver the documents that they have a mail with no response I am scheduled to be to your house tomorrow between 12 noon and 3 PM so please be ready I have two forms of ID as well as a witness to sign off on these documents if you are not home I will be making more unannounced visits just so you're aware and this is just a courtesy call so please try to be available if a home or I have an older wrong address that I will be parking this as a missed appearance so if you would like to reschedule that you may contact and file a party at the number provided in this message if you do not need to reschedule then I thank you for your time and I will see you tomorrow have a great day you may contact the mediator at phone number 877-871-3534 when calling please provide your reference number 1954359–8321 you may press any button to repeat this message…”
- Don P replies to KayGood day. I live in Texas and just received the exact same voicemail. Word for word. Jeffrey gets around! I calle d their number and was told I owed $16,000 from amercredit from an old car loan. I paid off that car loan 15 years ago! I told them they are scammers and if anyone comes to my house tomm they better bring the sheriff with them, because they will need it!

- KayJust received the same exact call, wording and everything. The call started out with an automated robotic voice asking for name and then followed by a very featureless message by this Jeffrey. Apparently, he's a private courier who is going to stop by my area, no address or city given, by tomorrow between 12 & 3 pm to serve documents thay require a signature, and if I'm not home he will make more unannounced visits until he's attained a signature. Yet, says if hes unable to get my signature tomorrow then I will be deemed a "missed appearance" against the "violent party". Yes, I could've swore he said "violent". The caller ID shows 1-877-385-0398 but the message provided a different # to call back which is the one in this forum.
