- KellyI received a phone call stating that i had two complaints filed against me and they left a message with a case number and i called the first time and the lady asked for my case number than she hung up, then i called again and a guy answered and i told him the ladies name that left the message and he acted like he didn't know who she was and he hung up on me too, so i don't know.

- Angela| 1 replyi just received a call stating that someone had filed a complaint against me and that I needed to call immediately to speak with them before I be summoned and that once I am summoned I will not have the opportunity to speak with them about the matter. It is so strange put an application with some agency and once they got my resume and what not I have begun to get these strange calls. I call the agency back but no follow up on the job though.

- Tim| 1 replyI got a call from these people saying i owe some pay day loan. Saying im being sued and need to take of this matter. Nothing adds up with what they are saying. Talk to like 10 different people in a matter of 15 minutes. First they say they were Brinkmen Assiociate then they say they are brinkmen alliance group. i search them up and no where to be found then i search their address they gave me and it was an industrial warehouse when they say they are attorneys? They are scammers. dont believe any of their BS. I ask for documents they said "oh we dont have that right now". Dont make sense if they are attorneys they should have all documents. sounds like a scam to me.

If someone represents themselves to be a "department of legal services" and is NOT a law firm, this too is a violation of law. This collector is NOT a law firm. They are NOT attorneys, and if they represent themselves to be, they would be violating the law. To file a complaint regarding any illegal tactics or threats, call the NYS Attorney General's office at 716-853-8404 - if you are threatened with a lawsuit

- Carrey D| 3 repliesI got calls from an unknown number periodically for a few weeks. Finally, one day, I answered the incoming call. The man who called told me that I had an unpaid debt and unless I called this (877)917-3536 number by 2pm to clear it up, he was coming to serve me papers to go to court. When I asked him what it was about he couldn't tell me but he DID give me my social security number and home address without me telling him anything. He said the number he gave me was for Brinkman Alliance Incorporated. I searched online and was unable to find anything. I called the 877 number and gave them a case # that the first man had given me. I heard some pecking on a keyboard and then the man I was speaking with told me I had unpaid debt from a payday loan. I have been working to fix some poor credit choices I made about 8 years ago and it is true that I DID take out a payday loan and had not yet paid it back. It was in another part of the country from where I am now. The man on the phone was able to tell me the exact date, location, and amount I took the loan out for. I was convinced. He said I could pay one lump sum or split it into two larger payments. I paid the lump sum. I got a confirmation number and was told I would receive a confirmation letter in the mail. I have yet to get that letter and now another #, (888)845-5988, is calling me threatening the same thing for the same debt. I have no other unpaid debt that I know of. So, now I'm thinking both companies are a scam. Any advice? Who do I go to about the scammers I've already paid, who do I go to about the scammers that are calling now, and who do I go to to take care of the actual debt? Thanks and DON'T GIVE THESE PEOPLE MONEY

- Elspeth replies to Carrey D| 2 repliesYou most likely paid scammers - NEVER pay any caller just because they can give you details. Per the FDCPA, they must MAIL (not email or fax) a debt validation letter showing original creditor, amount owed, date of loan, date of last payment and also whether they are licensed to collect said debt in your state. If they refuse to send this legally mandated letter, they are scammers who have no way of proving that you do owe the debt to them. It is also a violation of the FDCPA to threaten you with court if you don't pay. If you paid via your bank account, you could file a dispute for fraud, otherwise you're probably out of luck.
Again, never pay a caller any money unless they send you the required debt validation letter proving you owe the debt to them. Report both calls to the FTC, the FBI and your state's Attorney General. - Carrey D replies to ElspethThanks for the info. I figured I was out of luck and what I already paid. Live and learn.

- ChristineI received a message on my cell phone from a man calling from Brinkman alliance attorney office (I had to listen to the message several times as it was unclear) that there was a complaint filed against me and they were hired to obtain a current address and employer. They left the phone number 877-917-3536 and a claim #. I called this number back and told the person that answered that I had a missed call from this number, she asked me for the claim #, and put me on hold. A man then came on the line stating his name was Tyler Jones, and proceeded to tell me that a payday loan company was taking me to court due to an unpaid loan. He then told the last 4 digits of my social and said that the payday company said I defaulted on my loan by reason of insufficient funds or that my bank account had been closed. I told him this was ridiculous, because it was paid off. He then told me that he would contact the company to straighten this out and get back in touch with me on Monday. I then called this payday loan company to verify this information. I was told that I do not have any unpaid debts and they do not hire attorneys for collecting client information. I also went online to investigate this number and cannot find its owner.

- AnonEverything everyone said here is true 110%. Same is happening to me but he said he was an investigator for an attorneys office and a process server is gonna summon me at home AND my job. FYI I work for the federal government AND. Police dept PT. I also have lots of friends who are REAL lawyers and investigators. So now I'm calling the NYS att. General to file a complaint and get 2 of my lawyer friends to file somekind of notice with them.

- n/ahad a guy call me from a restricted #. said he was on his way over to serve me papers. and that i had an hour to call brinkmen and associates gave # - 877-917-3536 also gave me a case #. i called the #. guy said he was a debt collector -- named a very small very old debt that was once real but that i had paid off years ago. said i had to pay several hundred now due to interest. i offered to pay a fraction of the original debt to resolve the matter since I knew i had paid it in full before. he giggled but said he would ask the company if they accepted. he got back on the phone in less than a minute and said they would only go for the original amount if i paid it now. HOW DID HE GET AHOLD OF THEM SOOO FAST I HAVE NEVER BEEN ON HOLD FOR SUCH A SHORT TIME> anyway --- it was my first clue -- or at least the first clue i clued in to. we'll see what happens. he said i had one day and he would call me back tomorrow. you would think debt collectors would try sending me letters before they take me to court. if they really try to take me to court for that tiny amount -- good for them. it can not possibly be cost effective for them.

- VinitaWow, I have been being harrassed by these people for the last two days! Yesterday a man call me from an unknown number and says that he is a process server and he needed to know my current address to serve me papers. i asked him what for!? and quickly stated that i have not been in trouble for a few years now. What could this be? He said that he needed to serve me to appear in court because I was being sued. I asked about what he said I am just the server you need to call this number and give them the this claim number and they can tell you what it is about. I took the number and called it. A woman came onto the line and she asked for the number and looked up my information. She got on the line and read back my social and my address which I denied. Then she said that I was in the process of being sued and I became irate. For what what are you people talking about I have not done anything. She said you did not take a payday loan for Advance America in 2006? I had they had the amount. So continued to be rude and demand payment of 842.00 for a 315.00 loan due to interest and if I could not pay it now they would see me in court. I told her I could make payments for 25 bucks a month and she pretended to run this by her higher-ups (it too took less than a minute) and got back on the line and said no they wont do it pay now or go to court. I told her I couldn't so she hung up with the words "see you kin court". I panicked all night I got a kid I don't need no trouble and can't go back to jail. ( I know this silly thinking really) this is where my head was. So today I call ask to settle for 300 and the same quick conversation with his higher ups took place and they accepted the offer. Something keep ringing in my head and I decided to do what my boss said about 800 numbers and google it. I have found nothing but bad information. I did give them debit card number but then I also asked them not to process till tomorrow as I had to get the money from my mom and put it in the bank. They had not processed so I was able to cancel my debit card in time but what a headache. I said all this to say that they ate crafty. I am pretty street savvy but they played on my fears of being sent back into a life I hated with court and the implied threats of legal issues. They need to be stopped and how do they get our information anyways? Business like these are selling our information to them that is how they make up for their losses. They sell the debts to these third parties and let them collect on the debt kin their name because they BOUGHT the debt.

- AshlieI received a call that today as well. His name was Bill Gordin. He said I took a payday loan in 2003 and that I owed 300 plus 179 for lawyer fees and that I could split up the payments after asking the higher ups if that was ok. Luckily I didn't have my debit card on be at the time because I would've paid them. The thing is I told him I could prove that I paid the place off and he said if I paid now and sent him the paper work he could reimburse me. I also asked for him to send me an email pertaining this issue and I never received anything. I am going to call back tomorrow and give him a piece of my mind!!

- Michelle replies to law enforcementI just got the same call all these ladies got. What they do is have a private number call you to say they want you to sign something for 2 charges being filed. I told her it was crap right off the bat, because I know I don't do anything illegal.

Ms. Scott said that she needed to meet with her to serve papers relating to warrants for two misdemeanor charges. She said that information on the charges would be available from attorneys at phone number 877-917-3536.
My wife handed me the telephone and Cindy Scott related that she is a process server working for our county court. In order to confirm that claim I asked her for her badge number, which she provided. I then asked her the name of our county judge, the name of a local justice of the peace, or the name of our district attorney. Unable to answer any of the questions, she hung up the telephone.
I would hope that this person realizes that representing herself as an officer of the court can be a crime in many localities. If it is for financial gain by the use of creating fear in the victim, one might also consider the additional charge of extortion.- Caller: Department of Legal Services - Cindy Scott

- Elspeth replies to Mick the MouseReport the call to the FTC, the FBI and your state's Attorney General. Process servers do NOT call ahead to say they'll serve papers. Even if your wife did owe a debt, debt is a civil, not criminal matter. Next time "Ms Scott" calls, tell her she's been reported and that you're recording all calls she makes to you/your wife to give to your attorney (even if you don't have one) for a lawsuit for multiple violations of the FDCPA.
And remember - no proof of debt owed sent via USPS mail = no debt owed.
