they say they are from I.R.S. incorporated and are tring to collect on an older debt they say I will face wage garenshiment if I do not pay this bill. When I asked to have something mailed to me they say they can't do that until there is an agreement and they get the first payment either direct out of an account or charged to a credit card, this guy was so bold to even tell me to go buy a prepaid credit card.

Mr. Longwell, calling me again. Threatening legal action, saying they're issuing a summons that will be served to me this afternoon. Attempting to collect on a payday loan.  Refuses to send me anything in the mail, telling me I need to borrow someone's credit card.  Get a grip.  If you can't send me something in the mail, that tells me you're a bottom-feeding, barely-legal collection agency.  Just trying to bully us.

I just received a phone call from this number minutes ago and in searching for info I found this posting. My caller was a female who was looking for someone whom I do NOT even know. She said that the woman used my name as a "reference" and then further said that she used my address as her residence! I am clueless! I was alarmed and as I was trying to jot down the info, she kept trying to hang up with me. She told me it wasn't my concert if I was not who she was looking for. I told her that it was alarming and I was going to look into it as it was my concern if my address and name was used! As she tried to hang up I did get out of her that she was calling from IRS incorporated. She hung up before I was able to ask anything further. At first I assumed this had to do with the real IRS, which had me even more worried as she used my address!!! We have also been getting mail for this unknown person and neighbors say she never resided here... I am reporting this to the better business bureau or something.

In the military, haven't lived at home in 7 years. "Susan" and "James" calls my parents house and says I am being summoned if I don't give them money for a breach of contract! I have 4 contracts: cell phone, television, ADT security, and the US Marine Corps. Okay. They gave two extensions, *204 and *207. Tried to call the number back, and supposedly it was disconnected. This was minutes after I found out.

I wish I just worked it out with the lady that called me!

After being told they were from the "IRS" and that I was being investigated for fraud, and after they hung up on me when I requested to be sent a notice in writing, I did some investigating myself and found that this company had its collection license revoked in the state of Connecticut due to violations of Connecticut law. When I was told that they would be referring me to the Maricopa County Attorney's Office for prosecution for "fraud" and "writing a bad check", I actually called the Maricopa County Attorney's office, who said they take no such referrals from any private company, only law enforcement. They then referred me to the Arizona Attorney General's Office, who referred me to the Arizona Dept. of Financial Banking. When I explained that this company impersonates itself as the IRS, accuses people of fraud, threatens prosecution if you don't pay up immediately, and refuses to send a bill in writing when requested, they encouraged me to file a consumer complaint with their office. This agency is either grossly uninformed about Fair Debt Collection Practices, or they are so successful at scaring people into paying they don't care if they get sued. This company is out of control and I can't wait to file this complaint with my state.

I received a call from these guys today, concerning a legitimate debt that I have for a payday loan from CashNet USA.  I was nice to the caller & he was nice to me.  I explained that I didn't intend to default but had been laid off & then forgot about the debt & that while I would be happy to get my debt paid off, I can't commit to anything without talking to my husband first because I just recently was laid off again & we don't commit to spending large amounts of money without discussing it with each other.  At that point, the guy, a "Investigator Rogers" changes his tone, tells me that I have to make a commitment today (within 20 minutes to be exact, as that is when they were closing).  He said he is from Buffalo, New York & they close their office soon & this offer to knock off $100 off my $350 debt is only good today.  He told me he does NOT work for a collection agency & that he is NOT into customer service, but that he is calling on behalf of an "attorney" who bought my debt & that he is doing me a favor to try to prevent me from having legal action taken against me & he can't be certain he can spare me this legal action if I don't act today.

That alone was a huge red flag.  First off, debt collectors are supposed to identify themselves as such & they are supposed to state that this is an attempt to collect a debt.  This man never did that.  He only said he is NOT with a collection agency & that he is working with an attorney who wants to take action against me.  Second, when I told him that I would need to talk to my husband before committing to anything, he told me to call him.  I told him that my husband had been in a meeting at work & that he was now on his way home & I couldn't call him (here in California, it's illegal to talk on your cellphone while driving unless you have a hands-free device, which my husband does not).  At that, the man became agitated.  He told me that I could make the payment & they could hold it for a week so I could talk to my husband & if I decided to pay it at the generous offer he gave me, then it would be processed, and if not, it wouldn't.  I then told him I wasn't comfortable giving out my debit or credit card information over the phone without proof that he was legitimate.  At that point, this "man" became irate and began yelling at me, and telling me that he was deeply insulted that I would call him a thief.  I told him I never called him that, but that even the police departments and fraud protection agencies strongly discourage ANYONE from giving out their financial information to ANYONE who calls over the phone requesting it because that is how people get ripped off.  Instead of understanding my very legitimate concern, as an LEGITIMATE agency would understand, he became even more irate, began telling me that I had a bad attitude (I was actually very friendly, cooperative & polite & was willing to work with him as long as I could receive proof in writing that he was who he said he was).  Each time I tried to speak, he rudely & loudly interrupted me & wouldn't let me speak.  I then told him that he fit the stereotype of the rude New Yorker & he said he was from Florida & was working in Buffalo, which was nowhere near New York City.  I told him it didn't matter because he was living up to the stereotype anyway & that he might want to take a lesson from us in California about being more laid back & friendly because you get more flies with honey than with vinegar.  He began to cuss and scream at me, he threatened me with legal action & told me he couldn't protect me anymore.  He then told me that I could go ahead & hang up on him & I told him that I wasn't going to give him that satisfaction because I wanted him to talk in a civil manner with me (at this point, I was taking on a bully & I wasn't going to back down).  I asked him if he was even capable of being polite & being a gentleman & listening to what I had to say without interrupting.  He listened to me after that, & I very politely explained to him that I already acknowledged that I owe the debt & am willing to pay it, but that he needs to understand that he is a stranger to me & that without proof that he is who he says he is, I can't just give my financial information over the phone to a complete stranger.  He then said, "what do you want, a letter or an e-mail from me?" and I said "actually, yes, that would be nice, so I can check out your company - if it checks out, then I'll see what I can do to take care of this debt".  After that, he said nothing more about giving me the proof I asked for & in fact became more abusive.  I told him he was being verbally abusive & I was going to report him.  He said "how ya gonna do that when you don't have my number?" I said, "wow, for a person who isn't a New Yorker, you sure do have that pushy New York bully accent down" then I said "I have your number".  He said, "is it on your caller ID? Tell me what it is?".  I said "I don't have to tell you - just know that I have it" (it wasn't on my caller ID, but it was on the voicemail that he was leaving when I picked up the phone thinking he was from the actual Internal Revenue Service).  I then told him that I had my own attorney & that his "attorney" didn't scare me & that I WILL pay my debt, but not through him because he was being an abusive jerk.  At that point, he told me that I was the abusive one & he told me to blow it out my a*s, at which point, I said "we're done" & I hung up on him.

Per the FTC, a debt collector cannot be abusive or threatening, which this guy was.  They can't try to force you to pay something immediately in order to avoid unpleasant ramifications.  I am in the middle of filing a complaint with the FTC right now.  I can see from other posts that the number this guy gave me, (888) 228-7519 is worthless, but I'm giving that number to the FTC just the same.  This guy doesn't scare me.  I know he has no power to do anything.  I will pay my debt on my own, on MY terms, as I am unemployed & have to keep a roof over my head before I have to pay back a debt to a company who uses sleaze-ball collectors to do their collecting.  Legally, this guy & whatever company he represents has already broken the law in the abusive & threatening way he spoke to me on the phone (he refused to tell me what TYPE of company it was - he only said he is calling on behalf of an attorney & he said he does NOT work for a collection agency, nor is he in customer service - a fact which was obvious by how he conducted himself).  He doesn't have the power to do anything, so I will do nothing.  IF I get something in the mail, then good - I will take that to my local FTC office or attorney general's office & file a complaint with that information IF and when I receive it.  It may seem like a waste of time for me to file this complaint with the FTC, but the more people that do so, the more likely this slimeball & the others who work with him, will be stopped from victimizing others.

I had a fairly similar experience as California (11 Jun 2009), but with much less yelling and name calling. I vaguely remember taking out a payday loan from Advance America a few years ago (Leah Simmons is the one who's been calling and I spoke to her at first and she gave me all the info I needed to verify.) She asked me to hold and then a Travis Rogers (who is apparently the Director of Operations) got on the line and tried to strongarm me into setting up a payment arrangement ("today, I can't guarantee you this offer will be available tomorrow") He said that his business was a legal office, that they had purchased a portfolio of debts that they were now trying to collect on (but they are not a collections agency.) First of all, I don't see how this can be legal. Second, supposedly if I don't take care of this matter through them, they will go through the Benton County (OR) court system and I don't see how that can be legal either, this is/was a debt. What type of court system are we talking about here, criminal? If they are implying that they could at some point garnish wages, isn't that illegal too? Exactly what power does this business have as far as that goes? He refused to send me anything in writing unless I set up a payment arrangement first... Anyone else who thinks they did at some point have a legitimate debt and has been contacted by this company, has it been resolved? What have been your experiences since your post? Thanks...
