- Bethany| 1 replyI received a call from 716-247-5138, Buffalo, NY and received a message from "Brian Harper" stating that there was a pending civil complaint against me and my social security number. It was a typical, scammy type call and I will not be calling back. Please note that the return number given was not the 716 number, but 888-240-1485.

- SoBoringBrian Harper, paralegal, threatening to send my file to my local county court. Call back was the 888 number but called from a NY number. Didn't say who the debt was with, how much, or anything else really other than a case number. They called about 5 months (different phone numbers, same case number) ago with a robo caller. Seems like a scam. Have received nothing in writing.

- BeckyToday is the second day in a row that I get a phone call from Jason from UCM and Associates. Message said "In accordance with California law my name is Jason calling from UCM and Associates we left a message notifying you about a civil matter under your name and Social Security number. Again it's in regards to a legal matter, if our offices do not receive a response it will be deemed a refusal and then will then be referred over to the Orange County courts for further proceedings. If you wish to resolve this outside of court contact our offices back" it then gives me the same return phone number, but this time they have me a reference number. Is this a debt collector using scare tactics or is it something legitimate?

- Sam| 6 repliesI received a call from them & they sent me a letter, they are legit, and they're licensed LLC, they don't threaten to send police or arrest people like these other agencies out here, and she was polite. I don't know which accounts they sue for or if they even sue. And be careful to check if the debt a coll agency is calling you for is within the statue of limitations. You can google the stat for your state.

https://dockets.justia.com/docket/florida/flmdce/3:2016cv00403/321984) - BigA replies to LYou can always tell a criminal debt collector by how they don't follow Federal and State collection laws. The first tipoff is this, they fail to mail you a dunning letter that contains this information:
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
The second tip off is that after you send this letter they don't validate it, or it gets returned as address unknown:
You need to send them a certified, return receipt debt validation letter (think of it as the best $6.47 you ever invested). Also send it first class mail in case no one will sign for it. Make a notion of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. That I would need to call back of not I would be reported that I have evaded the receipt of these documents. The mssg sounds ligit & disturbing to receive at 7am. After, reading the mssg above its a scam. Shame on you!

Mind you this is the second call in about an month and no one has shown up at my home or job, she never told me who the debt was for or how much it was. It is totally a scam!!!!!!!!!!

And you can't pay your way out of being served, which is what she would offer you if you call her back. Just block and ignore the calls.

If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
You'll probably have to yell at them and talk over them.
