Do a stop payment/file fraud, If its not on your credit report, by law the burden of proof is on them and they are not supposed to threaten you. Some of these outfit buy up blocks of names, all the info does not get sent out with those sold off names  and you can get called for anything it seems, paid for or not!

Within 5 day's of first contact,as per section 809 FDCPA, they are required to send you a dunning letter of which you have 30 day's to respond. Demand Debt validation sent by USPS snail mail. Neither phone fax, email or text are legal proof of a debt owed, nor can you be charged fro fraud for a payday loan either. They are not even going to get a case into court that fast, they can do nothing. They are not supposed to threaten court either. Make sure you read through your rights! Also check the SOL for your state.

One important thing to remember if these losers have any of your personal information such as your social security number, date of birth or drivers license make sure you register with identity protection notify the credit agencies as well as your banks!!

***A company must be licensed in their state as well as the one they are trying to collect in if two different states are involved.

    Some Tips:
    *Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time, date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

Make sure you record what is said on the conversation! Understand there are laws against what debt collectors say to you!!!! They called looking for my brother, they called my 80 year old father and a ex-sister in law and told them they would have the cops at thier door if they didnt contact my brother or give them his phone number!!! So i called them and told them to have the cops come to my work and she kept ignoring what i was saying and i told her not to call his family members anymore. So she didnt take my work address for the cops to come!!! Understand debt collectors dont want to hear what you have to say!! They only want your money!!! Dont give them your money!!! Tell them the person they are looking for is in a correctional facility and wont be out for years!!! At the end of our chat she hung up on me telling me he would be mailed the paperwork!!!! So we will wait  and wait for the paperwork!!!!

Total scam.  No debt collector can bring charges.   Only public prosecutors can do that.  Being in debt is not a crime and you can NOT be arrested for it.  Ignore and block the calls.

The SAME exact thing, with the same number and names of people, happened to me. Only difference is that mine was different in amount. I owed the company (in 2009) $336 but he asked for $1,450!! The same conversation was had between me and this representative. He told me that I was being charged with having stolen merchandise because I bought something but didn't pay for it. I told him that not paying a bill was not the same as stealing. I reported this to the Consumer Financial Protection Bureau (CFPB). This is apparently a new scam on the rise, so pleas beware!!
