I said excuse me who the [***] are you and she does not even have my address. They did have my address, so I notified my kids and husband about this to make sure they don't open the door to anyone. They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency. They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer). They threaten to serve you at home or at work. They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work. They also tell you that you will need two forms of ID. None of which is true. Process servers do not ever call ahead so that you can dodge them. Process servers get paid to serve papers, nothing else. They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”. Court documents are time sensitive and must be served within a certain amount of time. Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

Now they're saying I have an HR to have my attorney call them or they will come to my place of employment t serve me.

Told me I am going to be served papers, kept talking over me and told me I was acting like a child when I asked what it was about. I told him it sounds like a scam and I do not deal with scammers.

They called again and I pretended to be a co-worker and told them "the person was not in her boss had given her permission to go file a police report against them" and that her boss will not be in he is on vacation and to stop calling the place of employment that we know they are scammers. All that man said was " ok we will stop calling but can you please just take a case# and a phone number" but will they actually stop ?

The context of the conversation goes like this from a "Sam Cruz". Here is the context word for word in regard to the voicemail left on a family member's cell phone;" This message is for...This is Sam Cruz, I am calling regarding a formal complaint that requires immediate attention.. (cannot make out the next words)...is scheduled to be delivered to your residence and place of employment, please ensure you have proper identification to ensure proper delivery. If you or your attorneys have any questions or concerns you need to contact our client at: 888.841.3258 reference/case number XXXXX.
Like most people I am leery of anyone trying to contact me out of the blue, making allegations or threats to 3rd parties i.e., family members and my spouse regarding me. I am not aware of any legal actions against me neither is there a reason for one.
I did my due diligence and check with the state's court records to see if there were any actions and nothing can be found, looked at my credit, and nothing out of the ordinary.
I find it odd that they never tried to contact me, or at least that I am aware of and the second if this was legitimate, it seems like a gross violation of privacy harassing 3rd parties, especially not knowing my relationship to the 3rd party (one of which we do not speak to).
I tried calling the number from an app and was hung up on by the system.
Called the number and was greeted by a woman, Nothing professional about the greeting.
Of course, they only want your information. I let them know that I do not feel comfortable giving personal information until we have established the legitimacy of the business.
Asked their name. Response Ashcan Associates <--Google searched and cannot find anything.
Where are they located? Her response: California.
This is when she asked why I am calling: I let her know that I have not received a call personally but my family has received several threatening calls and I am trying to establish the legitimacy of the business.
She asked for my case number. I stated once again, that I am not providing any information until the legitimacy has been established, was about to ask a follow-up question and she hung up on me.
At this point, I have contacted my lawyer and they can establish if this is a legitimate complaint/business and if not issue a cease and desist, and anything else we can do for the harassment.- Caller: 8884813258

They aren't going to be able to get any more information from this scammer than you were so they won't be sending that cease and desist letter nor do anything about the harassment.
