- BigA replies to KatieThis is a common ploy by criminals masquerading as debt collectors who are attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this, all for an alleged or nonexistent debt. One of the tricks they use is to call your work place, friends, or relatives repeatedly in an attempt to shame you into paying. They also use the “process server” ruse who calls and claims he is going to serve you, but then says you could avoid it by calling another number
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

The first time no number appeared but they said to call 888-481-9846 to avoid being served. The second call showed a local number that belongs to the local courthouse, however it’s the courts fax number. They left the same message both times with a fake case number. Next time I’m going to answer and mess with them a bit.

- MarySame thing happened with me twice, they said they were going to show up to my residence or place of work yesterday, they never did. They called again today- same message, told me there was a hold yesterday, and she was coming back out today or call this number and they can stop me from coming out. I think its a total scam to scare you. I did call the number, and I have never done business with the "party involved"
- Penny replies to Johana ReyasI have over the course of 5 years received these exact calls at least 3 times a year. Same load of crap every time. I finally called back and told them to please come serve me my papers I will have my two forms of ID and my 9mm and the local sheriff to arrest them because they have zero claims against me and threatening me is probably not legal. I then called back another time and told them the Fair Credit act and if they feel I owe them money to please send me in the mail or registered mail to the address they claim to have to serve me papers, all debt information. If they are an actual court or process server they will not call and warn you. A court will send any case registered mail not through some flunky service like this. Needless to say I turned it in to the Ohio Attorney General 2 times now and nothing is apparently done but sadly no one came to serve me any papers so I could provide them my Requested two forms of ID or my 9mm.

- PSmith2016I keep getting a call from Marie Smith and they provided me with the 888-481-9846 number. The person wasn't helpful, wanted my personal information, which I didn't provide. But I keep getting the calls on my cell phone and work phone. Telling me that I'm going to get embarrassed at work when I get served. I have not gotten a letter in the mail or anything. I have no clue who these people are and I even checked with my local county clerk office and I have nothing pending. I even called them today and been on hold for 30 minutes or more.

After all if you can serve them you can sue them so passing up on that leaves you with a lot of cash left on the table that you could have had. Your choice.
- BugzeeI keep getting a call from Joana Riaz and they provided me with the 888-481-9846 number to call to get a "Stop Order". I called the number with the attempt to end the harassing calls. I spoke with "Michelle", she wanted my personal information, including my social security # which I didn't provide; therefore, she told me she couldn't help me and was extremely rude and used extremely foul language. But I keep getting the calls on my cell phone, home phone & today my son who is away at college, who's cell # is one digit off from mine, received a call today also. They have told me that I'm going to get embarrassed at work or home when I get served. I have not gotten a letter in the mail or anything from them (not that they've told me what company they are from or represent), or any other collection letter, court papers, lawsuit information, etc. I have no clue who these people are and I even checked with my local county clerk office and I have nothing pending. They have called twice in the last two days. The first time # appeared as 631-318-3183, but when I called back I got a recording stating "This # is not in service". Second number that they called from is 908-766-0797, which is a Pizzeria's Fax line. I called the main line to the Pizzeria and spoke to the owner who had said he has gotten several complaints of this over the last week or so, but it is not them calling me & was very apologetic. I called my local county courthouse, and they have no record of anything pending against me either, they told me to block the number (which would be great if they weren't scamming all kinds of numbers), report it & if someone show's up at my home or work to call the sheriff immediately and they will come out to remove this people.

- Erik VolgageI received a message on cell voicemail this afternoon from a woman stating she represented a courier service to serve me papers. Considering I have zero debt or any other issues, I followed up with them. They told me that I owed $1500 to a debt collector. They tried giving me a bunch of fake information and telling me I was going to be arrested. I recorded the phone call and submitted it to authorities. They also decided to call and threaten my mother so I have now contacted an attorney to go after them. Do not fall for these scams! THEY ARE LIARS AND SCAM ARTISTS!

- SLWBeverly Marsh claims to be a process server (and she might be if that is even her real name) as well as many other callers that use shady tactics to intimidate people. As stated above, no process server will contact you. They show up at your home unannounced. That is their leverage; the element of surprise. Also they will camp out in their car and do some surveillance to try and catch you off-guard. They did this to a relative of mine. Legitimate process servers are usually certified by the National Association of Professional Process Servers, insured and/or bonded by the state they reside/work in. However, each state has their own requirements. Some only require a competent adult to serve a process but these are generally divorce or domestic cases. I suggest anyone reading this to educate themselves so you know your legal rights. I am sure these debt collectors read up on this information in order to appear authentic. They assume most consumers are ignorant and use this ideation to their advantage. The Federal Trade Commission has a document called, "State by State Survey of Process Servers". Usually process servers work directly for a law firm, debt collection attorney who represents a real company, or some other legal entity like the sheriff's office, not a call center. Servers can work for a courier service but again the client utilizing this service is in most cases a law firm or attorney. There is an additional fee(s) depending on how many attempts they try to serve a process if not successful the first time. In my county the sheriff will serve you. If a server does show up, ask them for their credentials and ID to prove they are who they say they are. Anyone can claim to be something they are not. NEVER give out your personal information over the phone or otherwise. The one who is attempting to collect the debt should know all of this.- Caller: Beverly Marsh and others
