Scam/Fraud - I asked who they are and what they want. The person who answered (African-american male based on on how he speaks) wouldn't provide me with company name or details about what they called about. Only wanted the phone number they called, which I provided. He couldn't find it and said that it may be about serving a notice to appear in court for unpaid payday-load. I don't owe any such loan and he wouldn't look up using any other method. Seems strange that he didn't ask for my name or attempt to collect any valid/update info to help them collect a debt or serve any legal papers. Most I called back again and can't get through now. My guess is this is a scam.

I have received 3 calls from this company wanting information to be able to serve someone with the same name as my husband.  The only difference my husband is 55 and they are looking for someone who was born in Dec of 1988 and this is concerning Student Loans, my husband has never applied for Student Loans.  I asked them to take my number off their list and they assured me they would but they still call.

They called my husband's job and said they are serving him with a supeona. First off, no legal office or court will ever notify you before serving you papers. They just serve you. Second, they have not attempted any contact to his residence or personal line. This is a scam. They are trying to harass or scare you into giving them a pmt or your financial information. This is not legit!!!!

We are a Bankruptcy firm and one of our clients just got a call from these folks claiming that they were coming to the client's office to serve her.  They provided a "case number" which I know to be bogus because it is not a case number used by any court in California.  Ignore these idiots.  Block their number if you can.

Keep getting a call from the same number. They dont provide a company name and all thay say they are going to serve me with documents and the number the provide for the case is not even a docket number. Cause courts use a docket number which would never begin with any letters and then numbers. They keep calling me and saying they are going too come too my place of employment and threaten to contact my human resource department which is illegal and against the law.

Worst bankruptcy lawyer in my opinion-Scott Shumaker. Yes, he did the file the bankrupcy documents and it went through but with mistakes. This lawyer may know the other lawyers and judges, brags about other lawyers being naive but he is the worst. Dont go to this person, I wish I never did.

This lawyer doesn't fight for you and makes mistakes, he allowed other accounts I could have discharged through Chapter 7 and now I'm stuck paying on it. Also, I stated I wanted a reaffirmation my car in which he told me I would and pointed out to me on the filing documents that it was, it was NOT THE CORRECT DOCUMENTS-he lied to me. I didn't know at the time that the other company that holds my car title has the reaffirmation documents. If the accounts I'm paying off were reaffirmed, it would rebuild my credit but since he did not reaffirm as he told me he did, it doesnt rebuild my credit. I still owe on other accounts that should have been discharged. WORST LAWYER, I wish I never met him. Plus he's expensive.

I received a call last week they would not give me any information about the collection or loan I owed, I asked for the pay day loan information and she just said she can send it to me but if O was served she could not talk to me after that. I went ahead and made payment arrangements but I may cancel my card after reading this and many other post. I spoke to 3 different people and I advise them I would make arrangements but I was still going to do my own research on this and go from there. The loan is suppose to be from 2008.

Cancel the payment and the card.  Never, ever pay an alleged debt collector without making them first validate the debt as required by law.  The fact that they told you they couldn't send you anything first is absolute hogwash.

This is a common ploy by criminals masquerading as debt collectors who are attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this,  all for an alleged or nonexistent debt.  One of the tricks they use is to call your work place, friends, or relatives repeatedly in an attempt to shame you into paying.  They also use the “process server” ruse who calls and claims he is going to serve you, but then says you could avoid it by calling another number

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Read up on your rights here, get template letters to send and also make a complaint at this government site: http://www.consumerfinance.gov/

Also file a complaint with your State Attorney General's office.

    Pay attention to BigA's notes!

If they didn't mail you by US mail a debt validation letter detailing the amounts owed, then you should not pay them anything.  Some states do not permit payday loans other states do not permit them to be enforced in their courts.  Many times the debt collectors are not licensed in the state where the debtor lives.  This looks to me like nothing more than your garden variety debt scamming operation.

.Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.

If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated

Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

If they are bothering you, report them:

http://www.consumer.ftc.gov/articles/0149-debt-collection (Threatening civil proceedings with no intent to follow through, or threatening criminal process in order to collect a civil debt is a  violation of the Federal Fair Debt Collection Practices Act.)  The same goes for endless telephone harassment

Also contact your local attorney general

If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

You'll probably have to yell at them and talk over them.
You have to get tuff with these people because,  being akin to thugs, brute force is (metaphorically speaking),  the only thing they understand.
