Provest called my neighbour trying to get info about us, claiming that they cant reach us. they have our right address and home phone number... whats going on?

We got that call on our neighbor and sounded wierded to us. We did try to call but could not get pass there computer. We do not approve of them calling and being BIG BROTHER. Sounds like somthing the feds should look into, could be wire fraud.

They called my brother.  Lots of disclaimers about them not being a collection agency, etc.  I'm not with ASC so I have no idea what it's about.  And it's not like I'll be calling them back.

Calling looking for info on me from a neighbor called this co and they wanted my SSN and DOB like I am going to give this info to just anyone sounds really strange to me after a screaming match and not giving my info I have never heard back if they know my address they need to send me something in the mail to confirm my info for anyone that they say they may work for

If Provest is looking for you, you must be behind on your house payment.  If they are performing a "skip", that means you have vacated the subject property and they are looking for you to serve papers on you.  Or you could be a "co-defendant" who holds a second mortgage on the property, or you have a judgement against the defendant, or you could have sold the house that is being foreclosed on to the defendant.  They are legit.

It is not that Provest's purposes of locating individuals for service of process is wrong it is the techniques employed by the company in their efforts to locate the intended potential defendants.  The tactics employed by Provest are the same as collection agency Skip Tracers which inadvertenty or not utilize deception to extract personal information.  My advice is to avoid answering any questions or providing information of any type to a  party calling you  anonymously as they could say they are with Provest and not actually be from the company, or vice versa.  Some tactics employed by provest could be illegal, although I would expect the company to deny condoning such actions. Results from their telephone operations is all that matters, and we all know the phone pros.

Statute states that in serving process, a "diligent effort" to located a defendant or co-defendant before publishing can take place to perfect service.  If all leads weren't followed, they didn't do their job properly.  If you are the main defendant, and haven't been located and served, your case will be published in the local newspaper in that county which will also effect service.  If you are out of town, or in the hospital for example, you will not have a chance to respond.  The reason for being so aggressive is so a defendant won't lose his or her house without ample warning and a chance to explain your side to the court.  If you are a "co-defendant" in the case, which can be someone that has a judgement on the defendant, or a second mortgage holder, you have to be located and served to legally retain your judgement.  How would you like it if "Joe Blow" owed you $10,000.00 on a judgement you obtained against him, and he is now getting foreclosed on, and you lose the judgement because you hid from or ignored the process server that was trying to serve you.  You will then be published against and lose your judgement without even knowing.  You would have seen at least some of your money from a finance company rather that seeing nothing from a defendant who hasn't paid you and is now losing his house.  Being served is for your own protecdtion, whether you are the defendant or a co-defendant.  Would you like to lose your judgement because you were out of town, sick in the hospital, or away working?  You would be very angry if you lost your residence, or money owed to you by a defendant if the process server didn't do a diligent search as required by law.  The you would hire an attorney to try and quash the published service stating no one was looking for or tried to serve you. If this includes calling friends or relatives, so be it.  If you would have made your house payment, or not ignored your finance company's phone calls, it wouldn't have gotten to this point.

Also, process servers are not bound by the fair credit act like collection agencies.  The are performing collections, and have their own statute to abide by.  Process Servers in are bound by their own statutes, such as FL.Stat. 48.  Look it up and read it, and you will see it is more concerned with effecting service properly for the defendant's benefit.  A process server can use any manner, as long as it is legal, to effect service.

To JME Esquire:  Good advice, however, if you really are an attorney, you are the kind of person who demands we do our job correctly and aggressively.  I get calls from attorneys just like you, all day long, wanting to know "is it served yet?"  Bet you wouldn't want one of your services quashed because the process server didn't diligently follow all leads, would you?  Also, some of the aggressive tactics employed by process servers/skip tracers wouldn't be necessary if people did what they were supposed to do, such as paying for the property they borrowed money to buy.  If there are other circumstance that need to be considered, that is why the defendant gets an opportunity to explain his or her side to the court in writing within 20 days.  Sounds quite fair to me.  Would be happy to debate this issue with you here, on the phone, or in person.

This is ridiculous! Our neighbors received a call that they are trying to reach us. This is not right at all. I have been in contact with the mortgage company and they have both of our cell phone numbers as well as a home phone and address what else do they need. Absolutely no right to bug our neighbors. That is humiliating and we have to live here......we are calling a lawyer.

The company you are refering to is a private investigators and process servering company.  If they are trying to contact you it is normally to have you served with foreclosure papers.  Or some other type of legal writ.  They are a legit company.  Their actions are legal and their conduct is normally as legitimate.  Sometimes some of their agents do go over the edge and cross the line.  But it is what it is.  Once again they are legit.  Normally your finance company hired them.

I worked for Provest, and while I understand the necessity of finding someone to serve documents regarding foreclosure, I have issues with the company's ethics in general.  There were many complaints of "drop" serving the documents.  While I was there many of the foreclosure processes were halted because some borrower's knew their rights.  If you don't sign in person, find out if it was drop served or another person signed for it.  Then get an attorney.. or find out how you can protect your rights.

Provest was so concerned about meeting time frames, they abused their employees, which may have contributed to "fudging" the serves.  

I have been a manager in another industry, and I would never recommend Provest as a place to work.  Fortunately, I am back in my "familiar" industry.

I can debate they are not doing things legit,,, seriously,,,,,,,

totally do not blame you, the info you say is correct, and there is way more illegal things that go on that they do not disclose to their workers... i would have to say the procedures and practices i know for a fact broke many laws......

You're all probably overdue on some bill. Geez. They are looking for your information to get you served or forward your contact information on to a collection agency. PAY YOUR BILLS and you won't get these calls. [***].
