My case retained and contacting me before further action is taken. As of today, they said, there is a temporary hold on any recommendation pending my statement of intent... they leave no company name. Didn't call back.

- BeccaGot a call at our office. Looking for a former employee. I told them the person no longer works at our firm. Lady said a summons would be served in 48 hours to the person at our office. I told her go right ahead, and good luck with that since the person doesn't work here, and has not since she was killed in an auto accident, 18 mos. ago. I hate evil debt collectors. She was a real witch ! But she is also full of crap. The person who worked here w any debt. I knew her very well. Best friends and she left her kids in great shape !

- Krystal replies to Dee| 1 replySo are they a legit company? They called me today stating I owe and said if I don’t pay I will get garnished but there’s nothing on my credit I even owe.
- BigA replies to Krystal
Well, they have to take you to court to do that. If they were to take you to court you would have their company name and address and could easily sue them for the threats they are making which is against the FDCPA. Then they would be writing you a check.Quote:I will get garnished
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1
