This company continues to call my cell number threatening to subpoena Denise Belay.  When I inform them Denise passed away in Jan 2020 they called me a liar and threaten jail time for me.  I called back and the man Julian tells me the only thing he will do when coming to my home to serve my mother is knocking my mothers ashes over!

Whenever someone tells you that they are a "lawyer" or that they work for a lawyer or law firm, the first question you should ask is what state(s) they are registered in and their BAR number for that/those state(s).  Then go to that state and check them out, contact them directly using the information in the state registration, as these crooks have been known to research real law firm names and attorney names and impersonate them.

One of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them and they can scare that person into paying their extortion money.  They often call people that have never even been associated with you because they get erroneous information off of the internet.

The fake process server/location specialist scam usually contains:

They mention that they have received a Fax document or that some sort of complaint has “come across my desk” and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and have to be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.

First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

Also file a complaint with your State Attorney General's office.

Claims to be Pennington Practice, also Pennington and associates, refuse to provide a bar number, the amount of the debt, this was after I called back the third time. Because he keeps hanging up. It's definitely a scammer, not even a legitimate debt collector. He threatened me, refused to even provide his name. But he had dates of birth and socials for myself and husband. I'm reporting this here and also to the Feds, Florida and Texas Attorney Generals, and Chase bank. We haven't had ANY credit cards since 2005, until recently. We have no statement balances, currently, and the 2005 credit cards were permanently closed in 2007 after a settlement, and remaining balance written off by Chase and reported to the IRS which we paid taxes on. So there is no doubt it's a scam. Chase confirmed, and said that our information was on the dark web. So look out.

This SAME thing just happened to me today, 09/19/2024....the very same scenario with Pennington, and their refusal to give their names, and getting belligerent when I was trying to ask questions. I too was hung up when they didn't like the questions. Incidentally, they said they notified me 90 days in advance before I am served (for a lawsuit) and they had "papers we need you to sign" -- I have NO debt, no reason for anyone to sue me. I also just asked politely what do I need to do for them, I never got anywhere with that either. Clearly, these are scammers. I can't imagine people devoting this much time and energy to scam people, and they don't even know how to do that right. I will be reporting them to the State Attorney's Office as well. P.S. When I asked what state they were in, the guy paused and then said (as if he were reading) "The beautiful state of California." NOBODY in California says that. When I asked for address (twice hung up on) a third person finally gave me the address...but it was Warner Bros. Studios address in Burbank.  Crooks.

They called my parents saying that they need to get a hold of me to serve me with some papers. . That they was told they can get ahold of me through my dad. When I called them they said I opened up a credit card in 2008 and that it was closed in 2011 but was a balance of 3,900 dollars. They had my address in hawaii and that was the address  that  I used to open it uo with. Joke is on them I didn't move to hawaii till 2023 . So how can I give my address in hawaii to open a credit card in 2008. They didn't want to listen to what I had to say. . But yet they had my correct address and s.s. number.  At the end I told them to go [***] themselves and hung. Up.

This phone number keeps calling my mother, who then relays to me that they have some paperwork to sign.  After reading these comments, I'm not calling back.  I have no debts in collections.  This isn't even the way they are supposed to contact me to "serve" me papers.  Bunch of hogwash I say!!!

    Ms. Bohanon
Received a call Sept 19, 2024 asking for me by a last name I haven't used in 19 years. I told him he had the wrong #. He said, do you know her? I say, wrong # there is nobody by that name here. After hanging up I called the # back. It was a recording: Legal Office leave a msg. I googled the # and the name John Davis Naziri came up. I could find no information on such a person.  This evening my son who lives in California with a completely different last name than me sent me a message he rec'd on his phone... inquiring about me and it said they had a subpoena for me and was threatening legal action if I did not disclose my location. So I called that # and all it said was: leave a message. I blocked both #'s and told my son to do the same. So I start using Been verified and both #'s came up as possible scams. Then a found a Jon Naziri in California. Upon googling the second # it came up Pennington Law.  I knew for a fact there was no way possible I owed money from my previous last name. Total scam using scare tactics AND calling family or friends for information.
