    I received a call from them today and was told they could garnish wages, report me to chex systems and wouldn't allow me to open a bank account for 7yrs plus i could go to jail for grand larceny. Would love for them to come 'serve' me; my brother's a cop. They can end up getting served for real.

    Real legal servers do not call, they just show up.  Neither phone,fax, text or email are legal proof of a debt owed.   The threats alone are violation of the FDCPA laws.

    Some Tips:
    *Keep all messages
    *Take a picture of your Caller ID
    *Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
    *Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
    *Check your SOL for your state as well.
    *Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

    Extortion Scam Related to Delinquent Payday Loans

    The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

    According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

    The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

    This is a common ploy by criminals masquerading as debt collectors who are attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this,  all for an alleged or nonexistent debt.  One of the tricks they use is to call your work place, friends, or relatives repeatedly in an attempt to shame you into paying.  They also use the “process server” ruse who calls and claims he is going to serve you, but then says you could avoid it by calling another number

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    They are getting soft.  Used to add "No TV for week" and send you to bed without your supper.   There is one outfit that says they will disable your social security card something like that.

    I've experienced the same thing!!! Received a call yesterday about a $748 overdraft Citibank account from 10 years ago!!! Lying and threatening that if I don't pay by 3:00 that they would serve me a summons. They claim that their name are Gilchrist Legal Services but I can't find them anywhere! I have my attorney looking into this. Today I received a call from a family member informing me that they were contacted. My thoughts are...if you moved forward with court proceedings against me then why are you now contacting family???! Scam!!!!!

    They call family, friends, and neighbors to create panic and to embarrass you into paying their extortion money.  There is no need to pay an attorney to look into anything other than to sue them.  Read Tamianth's and my posts above and remember this:  It is incumbent upon them to prove that the debt exists and that you owe it.  Not the other way around.

    Consumer debt in America is never a criminal matter. Collectors of consumer debt cannot whistle up police to act as proxy collection agents.

    Consumer debt derives from expenses incurred for personal and household purposes. Therefore the consumer debt umbrella covers payday loans and old bank fees from personal accounts. Therefore collection thugs working these debt types who wave about threats of arrest and jail time are breaking laws to make a fast dollar, and may be sued by their victims.

    You cannot report anything to a document. The final letter in FDCPA stands for "Act". You use it as a guide to legal collector behavior, to defend your rights as an alleged debtor, and to punish companies which deny those rights.

    I received a voicemail from this number, but the message was for someone else. Trying to do a good deed, II called the number back (from a different phone) to inform the caller they had not reached the person for whom the voicemail was intended. The person who answered the phone was the snottiest little [***] walking the planet who refused to allow me to speak to anyone else when I requested to do so because of her pissy attitude. She insisted the only way I would not receive any more calls from them was to give her my number so they could take it off of their call list. Now, why the hell would my number be on a call list if I am not doing any business with this company? SCAM!!!! I refused to give her my number and hung up on her...blocked the number so they can't call back.

    Called saying going to court (on discharged old debt). Their name and number do not match up to anything they claim. Also, they called a relative to leave a msg. instead of me, which was suspicious. Completely bogus.

    I received a voicemail that stated that PCSD came by with a sealed package containing documents. That is funny, I'm always home and no one came by. I'm assuming that this is a scam. The caller ID showed +1 (253) 243-9631 but they asked that I call a 888 number.

    PCSD just called saying I needed to verify my home address so they could serve me some papers. It was an automated message with my name added. They called from a number with the area code I like in 805-200-4680 but want me to call back a 855 number. Scam right?
