    These people called my job stating they were the local court and had a summons for me. however when i called back, i got an operator who answered it as corporate office (no name of company) and was put through to what was the apparent legal department of a Premeir Financial.  When i said i needed to find out what it was about, they had the wrong birthday but did have some other info that was right.  They stated it was about a First National Legacy Visa credit card(which i've never had) that i had defaulted on and what to do so it didn't go to court. When i questioned that it would be on my credit report if it was the case, the lady said that she had a copy of the report and it was the first one one there. i told her i would have to look into it and call back...  Funny thing that i ran my report right after i hung up the phone and there is nothing on there at all from First National. So total Scam.  Thankfully i did not give them any personal information at all!!!

    It is incumbent upon them to prove that the debt exists and that you owe it.  Not the other way around.    So since they have talked to you they are required to do the following, and failing that you know they are criminals masquerading as debt collectors:
    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
