    This company called my mother 3 weeks after my brothers death requesting a call back from the person responsible for his estate. My brother had no assets, lived on disability. He never put my mother on any credit references. I believe they gain access to phone numbers through funeral home data hacks of the person paying for those services. I called and told them it’s unacceptable to call a relative and make them think they are financially responsible for the dead person’s debt. I gave no details. They however now have my phone number. I’m blocking it for what it’s worth. I suggest you don’t respond at all or pick up calls from any 1-888… number. All legitimate businesses (credit card companies) send you paper notice that the account in question will go to collections for failure to pay and provide an address and phone number to deal with estate recovery. Since my brother had no assets it involves just sending them a copy of the death certificate to close the account.

    My deceased brother owes nothing, but yet they call. I gave them his wives phone number. Scum bag collection agency. I reported them and if the calls don't stop, then I will hire a lawyer to sue them for harrassment. If Florida you can recover up to $1500.00 for each time that they call you.

    No, you cannot collect that amount of money on an FDCPA lawsuit.  Maybe you should actually talk to a real lawyer instead of reading misinformation on the internet?

    You will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested).  Also send it first class mail in case no one will sign for it.  Make a notation of that fact at the bottom of the letter.  You also need to report them to the proper agencies to which I have provided links to.  Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment.  If everyone did these three things, these crooks would be bankrupt, and we would all be the richer for it.  Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front):  http://www.consumeradvocates.org/

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

    Just got a call from Ascension Point Probate about my uncle.  I did not know he had died (01/20250, but I haven't seen him in over 50 years.  The man on the phone said they were looking for who might be the executor of his estate.  I continued to question him getting his phone number, and asking how he got my number.  He said that they did a people search and that they were calling all persons listed as relatives.  I suggested that call one of his three children, and said I was just his niece.  He said good-bye. Ascension Point is a debit collection agency, do not give out any information to them.  It was a sad way to find out my uncle had passed.
