- Tina| 1 replyThey are repeatedly calling me saying they are a compliance company FCS. They said I took out a loan in 2018 from VIP Loan Shop and I breached the contracted and failed to pay the loan. I have never taken out a loan and they told me that I'm being taken to court and I will have to prove it in court and I'm being sued for $5000. The number that shows up on my phone when calling is 916-229-8386

Their statements prove that they are scammers. They are saying that to scare you into paying them to avoid going to court. They will most likely tell you that you can settle for much less that $5000 (probably half), but only if you give them payment information over the phone then and there.Tina wrote:I have never taken out a loan and they told me that I'm being taken to court and I will have to prove it in court and I'm being sued for $5000.
If the debt were real, you would not have to prove it was not yours (the concept of "innocent until proven guilty"), they (as the plaintiff) are required to prove that:
1) The debt exists.
2) The debt belongs to you.
3) They have a legal right to collect that debt.
Being scammers, they fail on all three of those requirements: The debt is fiction, is could not be yours, nobody has a legal right to collect a fake debt.
When dealing with any debt collector (real or fake) the following information is useful:
(Information oft posted by regular poster BigA)
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contain a “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that dispute/debt validation request letter by certified, return receipt mail.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/complaint/
Also file complaints with the FTC: https://reportfraud.ftc.gov/
Also file a complaint with your State Attorney General's office.

I called back and spoke with a “Mike Connors” who refused to answer any of my questions and hung up on me. “TSG” is not a mediation company in Texas. I called again and a woman who clearly was new to the job kept putting me on hold to ask her scam artist boss what to say. Rest assured this is a scam.
