I just got a call from (716) 805-3301 stating that it was for bad checks (payday loan defaulted on) and that I should contact Tiffany Smith - then she left a voice mail stating they were going to take legal action - because they can in the states of Texas (so she said) ...and left the number 888-832-7137. Tired of the phone calls and already got scammed by one other collection agency.  Another thing - she does not identify who she is calling to represent - so why should I pay attention?

I just  got a vm from number: 888-832-7137 saying this a call regarding a bad check, also stated that they have attempted to serve me with some paperwork at home but have been unsuccessful, if I don't call him back they will be forced to serve me at my place of employment and the authorities will be informed that i wrote a bad check, legal action and charges will be filed. Ok, first of all this guy doesn't even say who the heck he is or what company he's calling from; second of all, I've not rec'd any paper work at home, usually when someone wants to sue you they have to serve you with a Summons & Complain, then you have 30 days to respond whether in small claims or higher; but you see these people don't know any better, they think they can intimidate you by calling and making threats; in the State of California defaulting on a pay day loan IS NOT A CRIME, thus it can not be filed as a crime specially if they are located out of state their rules do not apply here.

I hope this information can help someone else who is also getting this type of calls

    PAYDAY LOAN ABUSES http://www.affil.org/consumer_rsc/payday.php#abuses

False threats:  Payday lenders sometimes threaten borrowers with criminal prosecution for writing “bad” checks.  In fact, there is nothing illegal about writing these checks (if there were, payday lenders would be aiding and abetting a crime each time that they told a borrower to write a post-dated check). .Nevertheless, many consumers are terrified by these false threats of criminal prosecution.
