- Jess| 5 repliesJust received a call from this number 888 845 1394. It states something about case documents being sent to my house that I have to sign for. The phone number listed above is to a florist in Kansas. This is also the number left in the voice-mail. The message is incomplete as it is a recording that started up before the voice-mail started recording. This has to be a scam. Beware

- LoriI have gotten the same message several times and block the number, then I get the same message from another 888 number. I called one of the numbers back and got a call center and the person wanted my name, etc. I said she called me and should be able to pull it up with my number and told her I thought this was a scam. She became angry and told me not to waste her time and hung up on me.

- Crystal replies to Jess| 1 replyJust got the same call, second time actually. I pressed 1 to speak to case manager and they are looking for my exhusband. nothing to do with me and did not try to sell me anything or get anything from me so it may be legit since my exhusband is a dirtbag that is very likely to be getting sued by someone for something. it could be that the florist used to have that number but no longer does. unless the florist acts also as a process server in their offtime
- Crystal replies to SarahI was connected to what sounded like a well spoken very much American woman when I pressed 1. and I didn't have to tell them my name they were looking for my ex husband. didn't even ask what my name was they told me my ex's name. they apologized for the intrusion and said they would notify the processor and remove my number from the system.
- BigA replies to CrystalThere is absolutely nothing legit about this. If you are being sued you don't get a phone call. You get served. If you are being sued your family, friends, former family and friends don't get called telling them about it as that is illegal. You should also look up "caller ID Spoofing".
- BigAOne of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them so that they can scare that person into paying extortion money. They will usually also state information that would be illegal for a real debt collector to state to department and tell them that you are a deadbeat who does not pay their bills. They often call people that have never even been a third party such as that you are being sued, that you owe money to someone, etc. They threaten that if you do not call them back, they will contact your HR associated with you because they get erroneous information off the internet.
The fake process server/location finder extortion SCAM usually consists of the following:
They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency. They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer). They threaten to serve you at home or at work. They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work. They also tell you that you will need two forms of ID. None of which is true. Process servers do not ever call ahead so that you can dodge them. Process servers get paid to serve papers, nothing else. They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”. Court documents are time sensitive and must be served within a certain amount of time. Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1
Also file a complaint with your State Attorney General's office.

- Karen replies to JessI just received the same message.
- EddieI got a call from an unknown number (labeled "Spam Risk" on my caller id) with an automated message stating that there are some legal documents I need to sign and to call above number or press 1 to reschedule documents delivery. If you press 1 or call back you get some overseas call center. I hanged up but definitely a scam attempt. They won't just do some random call to tell you any kind of legal matters, it's not even legal. I bet they would have asked for all my personal information to steal my identity, ask for money "to cover some fees", or probably both. Beware.

- SaraI pressed 1 to speak with a case manager to find out what this was all about since these scammers have been calling me everyday for weeks now. A pleasant American woman answered "Litigations, how can I help you" I said I want to schedule a time to be served, she asked for my case number, I told her I didn't have it. She asked me if I was (insert my sisters full name), I said there is nobody here by that name, then she says then am I speaking with (insert my full name) I said yes, what's this about? She says I am a point of contact for my sister, there is a pending case, blah blah blah well I went off the rails and cussed her out about this scam. She told me to get back on my medications, LOL! I then called my sister and warned her if they contact her TO NOT FALL FOR THIS!!!!
