    Same exact transcript (except it was addressed to me) as the previous complaint. "They've tried to serve me twice", etc...they also left that message on a voicemail of someone I know (again addressed to me). There is no pending court case for me in the county they stated

    Got a voicemail that came from an "unknown" number. Said they were from "american process dispatch". Got the same transcript as mentioned above, except directed to me. I knew it was a scam right away, but i verified it with my neighbor who is a deputy sheriff for the county they said they had court papers from. Decided to call them for the hell of it.. They immediately answer "litigation" or "legal department". When I asked where I was calling or who I was speaking with, they refused to give me that info.. just kept asking if I had a case number. Gave them the case number and they wanted my last 4 of my SSN to "verify" who I was. When I said I wouldn't give it until I knew who I was speaking to, the lady hung up on me. Called again, this time while recording and "verified" my last 4, and a lady named "Monica Vaughn" goes on to tell me that they have some collection from a bank from 2009-2010 for almost 2 grand and that they were filing against my income tax, and that a server would be out at my place of employment tomorrow between 11-4. Funny, since I've never had a bank account at that bank. Asked "Monica" where they were going to serve me, and she told me she didn't have that info because she wasn't the server, but I better believe they have it. When I told her I never had a bank account at that bank, she proceeds to tell me matter of factly that I DID have an account there, and that is how they got my case. I told her I wasn't even in this state at that time, and she told me that I personally went into the bank, and they have copies of my Drivers license, etc.. and that the judge wouldn't care that I wasn't in the state.. it's irrelevant. She then proceeded to tell me that my case has been to 6 different collection agencies, and now their firm is filing against my income tax. Yea.. ok. Still reported to the BBB, the Attorney General's office, and local police department. My local pd is putting someone in the area tomorrow between 11-4 to "assist" the server with any business they have

    Got a call today from a Justin Daniels from American Process Dispatch1-888-746-8540, same script basically as many of those listed above. Notifying me that they have a case pending against me to appear in court next week for a bank account that was closed in 2010. I asked her shouldn't I  have heard from the bank about this a long time ago...I mean it's been almost a decade. She said the bank puts it on your credit report and leave it there until the statute of limitations runs out then they file a garnishment against my wages. I said Wow I don't believe this, trying to sound very distraught over this complete [***] that she was trying to sell me. She then said hold on one moment there may be something we can work out. She put me on hold and I hung up.

    I just got this call for my husband today. I answered the phone and talked with a lady but she wouldn't tell me what the documents were for. I told her to call back and leave a message.  It was the same exact message other people are saying.

    Left the same message you all were getting above.  Smelled of scam, then I found out they called my wife and sister.  So I decided I would call them and let them have it.  Wouldn't you try me by myself first?  They didn't pick up their phone when I called.  I then called back 5 TIMES throughout the day and they just started to pick up and hang up on me.  Clearly scam garbage.  If by some miracle I get served paperwork, I'll let you know.

    One of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them so that they can scare that person into paying extortion money.  They will usually also state information that would be illegal for a real debt collector to state to a third party such as that you are being sued, that you owe money to someone, etc. They threaten that if you do not call them back, they will contact your HR department and tell them that you are a deadbeat who does not pay their bills.  They often call people that have never even been associated with you because they get erroneous information off the internet.

    The fake process server extortion attempt usually consists of the following:

    They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and must be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.  If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

    Crystal Harris from American Process Dispatch of Lee County - She called from unknown # and left voice mail for my son. Stated 2 attempts had been made to serve regarding a hearing on a court case and service was not possible, he was going to miss and important hearing. Left a case # and to call their Legal Department 888-212-2526 to resolve the issue. Stated that this call serves as him being served. I called the # and the person who answered said "I see your phone # and I'll call you back because I'm on a conference call". I have searched and there are no cases with that # for my son.
