- Elizabethi got a call from a restricted number and so did my mother ( in regards to me)with a message to call michelle. i called the number..but dialed *67 first and"mike sanchez" at a "law firm" answered the phone and wouldnt give me any info because i wouldnt give my nme. the guy was very rude and hung up on me.
- Yoo Hoo| 1 replyMichelle Williams called and left a message that she was a process server attempting to serve legal documents at my home or employment regarding a fraudulent check charge in an attempt to defraud a bank. She provides a Case # but doesn't identify the company she works for. I called the 888-595-5943 and a man answered "Mike Sanchez". I asked what company this was and he said "Who are you?" I said "What company is this?" And he said "Let's start by finding out who you are." I said again, "What is the name of this company?" And he said "Tell me who you are." "You called me," I told him "and I want to know the name of this company." He said "ARG Processing Company". (I quickly Google searched and there is no such company.) I said "What does this company do?" And he said "We are a processing company". I said "Are you a collection agency?" He said "No, we are a lawfirm." I said, "A lawfirm?" And he said "So what are you afraid of that you won't tell me who you are?" I said, "Your company left a message on my phone and I want to know who you are." He started yelling, "So what are you hiding? What are you afraid of? Have you got something to hide?" I hung up on him. IMMEDIATELY my phone rang back with "Private Number". I let it go to voicemail. He waited for it to go to the point of leaving me a message, only so I could hear him hang up on me.

- MarnieLeft message stating that they are a state process server and they are trying to serve me with a court summons for a fradulent check charge and breach of contract. Says there is an addendum that I can settle it with them and it will not go to court but must be settled in 24 hours, or "we and the authorities will actively seek you out at your home and place of employment" and that it will be tried in my absence in court and I will be charged with a failure to appear and arrested. Then the call finishes with "you have been officially notified".

- Texas BoyThey left a message on my work phone as well, threatening to embarass me at work and when I called them back i asked for their company address, which they would not provide. Mike Sanchez got on the phone and he was cocky from the start. He claimed to be an attorney and when i asked him for his New York state license number he refused to give it to me. He then became rude and defensive when I asked for info about his "company" so i can reference through the better business bureau.

I then asked him for his number and he would not give it to me. I asked him for his company name and he said that he was with the State Of Texas Stanford. And to call this number and that I had 24hrs. I told him that my attorney would contact them.

- kristinIve had the same problems. They had some of my information but alot of it was wrong. They threatened to seek me out at work or home try my case without me fta blah blah blah. They said I had a bank acoount that the bank went bankrupt in 2008 and had no branches anywhere near my state. He said he would be at my house with the law and hope I could prepare a good defense. He hung up on me. My husband called him back and asked him why he was saying he was going to arrest me and he got loud and rude with my husband and then hung up on him. Then he called me 3 times today leaving messages Saying he ran the email I said wasnt mine through all "the networks" and it was mine. They are all scam artists do not send them money. He wanted me to go get a walmart prepaid card and send him the info to it to pay this blah blah blah I will not hand my money over to a scam artist Mike sanchez, Ms barbra gordan, michelle williams, francis connor, adam mills they all called me all playing a part. Adam Mills said he was a process server coming to serve me and in the background I could other scammers screaming at people on the phone. These are low down disgusting people. Do not give them money.

- angieWell i received a message from a girl call mitchell she told me they were a companny call arg processing law firm wish it make me think .but then she said to this in referent to a court trial that i have to go to so i got real scare and she event told me they could arrest me if i dont paid .so i asked her for a phone number to reach her and she said you could call me to my dirrect line wich it was 1888-626-6420 well stupid me i me after she gave me all my information even my ssn #i said well the only thing i could do is allow every two weeks paid you 100.00 but on july i call them and told them to take 25 a month so michell told me no problem but after agust they took 25 every two week so i call them at the number they register at the bank and the number wws bussy and after that the number is beibg check for problems but my bank need it more proof reason i a law the trasantion to be done .so even if the bank themself call and it gave them a bussy signal they were not able to help me so i went on line and this is what i found the compabny never exsist how safe we could be now in they how do we trust not even or banks sad what are we becoming. so i said fine no problem

- LisaI just received a call say his name was Mathew Ward from ARG, he stated that my husband owed on a credit card from 1996-2002. I asked him how he got my number he wouldn't tell me. I told him that I would have to call my husband and ask him about it we were not married then. I called my husband and he said he never had a credit card with the company in question, my husband called him back, and ask for proof. Mathew from ARG stated are you refusing to pay and my husband said I need to know what it is for. Mathew from ARG stated he was turning it into the IRS and a lien would be placed on our accounts.
I called the number this Mathew had called from he answered it directly and I said this is absurd, it was a bully tactic to try and get money, we have never received anything in the mail. We wanted proof, he replied our accounts would be turned into the IRS. I asked to speak to his supervisor I also asked what was the name of the atty for this company. I was called rude and stupid.
I don't know how he got my phone number or the address for the home we are trying to purchase.- Caller: ARG

He stated that I was about to get a class three felony because of a bad check, he said Advance America tried to contact me through 3 different third party collection vendors and his law office was the last attempt. I asked him what address do you have on file? He told me a 3 year old address. I told him he has the incorrect address and I would like all documentation on file sent to me...he said that he cannot do that because this is about to be sent to court. I told him I was not aware of the situation and it clearly noted that you guys have the wrong address. "... if the small lender knew, at time of receipt, that the account had insufficient funds, or that the check was postdated, the issuer has not committed the crime of Check Deception"
(Although that is a citation from Indiana law, the laws are similar in most states that permit payday loans)
Here is a citation from the Uniform Commercial Code (UCC), which is valid in ALL 50 states:
Section 3-104(2)(b) of the UCC, defines a check as “a draft drawn on a bank and payable on demand.” A postdated check, since it is not payable on demand, does not satisfy this demand. Consequently, it has generally been held by most states that the giving of a post-dated check does not constitute a present fraud nor is it within the scope of the bad check laws.
Yes, borrowers should pay their debts, but lenders must (by law) follow the correct procedures to collect those debts. A summary of the Fair Debt Collection Practices Act (FDCPA) is here:

Some Tips:
*Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.
