    I got a voicemail from this number giving me a case number saying they wanted to know if I would be home so they could serve me court papers.  Sounds awfully fishy to me.!!!!! Seems like a scam, I could not verify the phone number when I tried calling back.  The person would not give me the name of the business.

    Extortion Scam Related to Delinquent Payday Loans

    The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

    According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

    The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

    I received a call from a private number that I they had legal docs to drop off and if I was going to be home and I said I am not accepting documents without knowing who they are from and she gave me the 888-980-4804 and a file number I called back and the lady that answered tried to make herself sound like she was a law office and some line about your documents will be delivered today, hold please let me find the file...all very dramatic. She finally told me she was collecting a debt that was from 2004. I informed her I was sorry she bought a bad debt however I was not going to pay it, being it was over 10 years old, she said that didn't matter. The address they had on file I haven't lived at in 5 years. She went on about how I still owed the money and I was a horrible person for taking out credit and defrauding the company by not paying. I reminded her that in her own words she said she purchased the debt that had been charged off. If the original creditor wanted to contact me they could, of course she didn't have an answer for that.

    I want to remind people no matter the tactics there is a statue of limitations on debt no matter how many times it gets purchased...it differs by state. Educate yourself before paying an old debt. In this case she is very much outside the statue of limitations and I can't be sued for it and it is just plain and simply harassment.

    One unexpected consequence of your suggestions may be that you have to pay taxes on the old debt that you still owe when that debt was written off or when the statute of limitations has run out.  The money you borrowed wasn't a gift to you, and the person or company owning the debt may have deducted it from his/her/its taxes.  The IRS may then consider the amount written off as taxable income to you.  Your state may do the same.

    You should consult a tax advisor or lawyer to get up-to-date information and guidance for any particular case rather than rely on my say-so, as it is foolhardy to rely on generalized advice you receive for free on the Internet from anonymous sources like me (or you, for that matter), and I am not your lawyer nor is what we discuss privileged or confidential or subject to any attorney/client relationship.  But here is some other published and easy-to-understand information for you to consider:

    The 1099 C must be issued by the original lending party if the lending party is a Federally regulated entity.  In addition, the Statute of Limitations only applies if there was a judgement entered to that effect.  One other thing, once the 1099C is sent, no further collection activity is allowed, by anyone.  Also the 1099 C must be filed in the year the event happened.  Not years later.

    It certainly does, insofar as trying to explain the issues involved here on 800notes.  I've never had to deal with that particular issue for me or known anyone who had to deal with it themselves (albeit they probably wouldn't tell me if they did), and I don't foresee any chance of it happening in the future, either.  So I have no particular expertise in this area, and do not make any such claim.  But at least I am aware that it *can* come up as an issue in at least *some* cases.

    Now I can refer people to the IRS publication you cited in case they ask again.  Thanks again for finding it.

    The statute of limitations limits legal action.  A creditor cannot file suit after that date has past or the suit will be dismissed and sanctions could be granted.

    Quite right, but that doesn't stop bottom-of-the-barrel zombie debt collectors from calling you. There is no shortage of single cell individuals who'll happily pay pennies on the dollar for such debt. The potential profit is there. Yes, the debt is not legal to collect by Court, but call they will.

    Yes, this particular one likes to violate the FDCPA like a dog does a yard.  If they get hit enough, they will go away.  There is a whole new practice of law involving FDCPA violations.  The amount awarded to consumers is limited to infractions, but attorney fees and fines can easily add up to 6 figures.

    called and said i owes Bank of america for a credit card and they needed to serve me with papers today and i was being sued....had me call another number and make arrangments, the guy said he wanted 450 dollars to stop procedding but needed a card or debit card number today. I told him i  needed something from the company and he was willing to email it but i said i needed something in the postal mail because that stuff can be faked...i said I would take my chances with court.
