I've told them I don't have it, they asked me to borrow from family! I told them that's impossible since I don't have family (foster child) and the guy basically called me a liar. The Fair Debt Practices Collection Act (FDCPA), a federal law, only applies to third party collectors - i.e. debt collectors or collection agencies.
The provisions of the FDCPA are not "rocket science." Look up the text on the Internet.
The FDCPA applies to all consumer debts.
If the consumer prevails reasonable attorney fees and court costs are awarded.

- BigA replies to TruthComenity Bank issues branded credit cards. While their interest rates are a bit usurious, you were given the facts when you signed up for the card. If you get behind on one of those cards, you can expect a call from them at some point. I have no doubt that they get aggressive when ignored. If you don't have one of those cards, then I would suggest that you send them a certified, return receipt cease comm letter.
