The rules which govern telemarketing cover phone calls made in both directions, whether initiated by the call center or by the curious consumer. Blanket abolition of all telemarketing is absurd on its face when we review the activities it would destroy. No more upsells during customer service inquiries. No more direct response advertising, a/k/a long TV ads during the cheap hours.
You and I could list the reasons why we might not miss those sales methods. But more critically, a company you know and trust can never again sell you anything over the phone, even if that's what you want. Consumer law favors deterrence over blackballing so that honest companies are not placed at a competitive disadvantage. Not to mention, the FTC has no time to fight entire industries over "restriction of trade" protests.
