- RosieMeToo! A Mr. Thompson called from 201 461 0023. Same thing yesterday only it was a girl.
The bill was 600.00 yesterday and today it is 1500.00...same creditor. "Is it my understanding that you are refusing to pay this bill" and followed by "we will have to start proceedings then". He became rude and ended with "I am sorry you don't want to pay your bills". I will block the number because I don't have time to play his games. Fortunately, when I block a call the caller ID sends me the number but I don't have any annoying rings every five minutes.- Caller: Cawley-Bergmann

- MI've been receiving calls from "Alex" at Cawley & Bergmann recently. 201-461-0023 is what shows in the CID for all of them, and they're all pretty much the same:
"This message is intended for <Name>. <Mr Name>, my name is Alex. I'm a debt collector calling you with the offices of Cawley & Bergmann. We're trying to get in contact with you <Mr Name> regarding a file that you have pending with this office. I actually have some good news regarding your file, sir, if you could return this call today <Date>. I will be in the office until <Time> Eastern Standard Time. Take advantage of this call and return it as soon as possible. My number here is 855-xxx-xxxx. When calling in, dial extension number xxxx and reference file number <1234567>."
All three messages are delivered in a rapid cadence except for the contact info, no doubt intended to confuse someone into calling back. One evening, I received two calls within as many minutes from "Alex." The first one was to my cellphone. When I didn't answer, he immediately dialled the land-line (which does not belong to me and is never used when giving contact information). The message to the landline number was heard by a third party, in violation of FDCPA disclosure rules. In addition, I believe all the messages are in violation of disclosure rules, as there is no pause to disconnect the call if the listener is not the intended recipient. He simply launches straight into "I am a debt collector."
I finally got a letter in the mail, and the matter referenced is one that was subject to a civil suit last year, and was dismissed with prejudice. Amusingly enough, the collector in that case violated the FDCPA enough to be liable for more than they were attempting to collect from me, AND they never properly validated the alleged debt. With the failure to validate and the dismissal of the case, I can't see where they have any grounds whatsoever to continue trying to collect. Especially since they are barred from further litigation in this matter.
So from my point of view, no "mini miranda" plus violation of third party disclosure rules means two FDCPA violations with each call, for a total of six so far, plus attempting to collect on an uncollectible matter. I will be discussing the matter with a lawyer and having them listen to the messages (saved in multiple locations on multiple devices, I'm no fool) and look into the possibility of suing not only Cawley & Bergmann, but the debt buyer who hired them as well.

Federal Protection for Debtors as set by the FEDERAL government. These callers are in violation of many statues of the FDCPA. Threaten to report them for violating federal law and see how fast they stop calling. Ask for their name, the company name, phone number(s), and supervisor's name.- Call type: Debt collector

- MJust noticed there was yet ANOTHER message from "Alex" at Cawley & Bergmann on the landline number from last week. This time, he stated that I "have to get in contact with this office today", and went on to say "we have to know if you have a lawyer representing you regarding a file placed with this office."
The number given was different from the previous messages, but the same extension. The landline called is not associated in any way with what they claim I owe, and hardly anyone calls it to begin with. So now they're looking at yet another third-party disclosure violation, no mini-miranda, and now they can add threatening legal action they are not allowed to take, along with intimidating/coercive tactics. So we're up to nine or ten violations from them all told. I will be contacting a lawyer this week and taking the fight to them. I THEN PUT IT TOGETHER AND THEN YELLED AT THE PERSON CALLING SAYING YOU CANNOT DO SOMETHING LIKE THAT SAYING IT IS AN EMERGENCY. PERSON STATED THAT WE OWED A CHARGE CARD BILL FROM 2009 - MY HUSBAND ADVISED HIM HE WAS NOT AWARE AND WE HAVE A RECENT CREDIT REPORT SHOWING NO ACCOUNTS OPEN UNDER THE CHARGE CARD IN QUESTION, MY HUSBAND ASKED FOR DOCUMENTATION WE PROVIDED 2 EMAILS. OF COURSE NOTHING CAME OVER. PERSON IN QUESTION CALLED BACK AND ASKED AGAIN FOR MY HUSBAND AND HE STATED WELL YOUR HUSBAND SAID HE WOULD CALL ME BACK. I SAID HE WILL CALL YOU BACK ONE YOU EMAIL THE DOCUMENTATION. OH YOU DID NOT GET THE EMAIL - REALLY - I WILL FILE A COMPLAINT AGAINST THIS COMPANY

- Comcast Phone Number OwnerWe got a new phone number from Comcast, and it has been ringing at least once per day from this debt collection office. Apparently Bergmann Cawley is showing their aggressiveness to debt holders (perhaps billing them by the call), without disclosing that the numbers they are calling are no longer owned by the people the debt is owed by. People who don't pay their bills lose their phone numbers. The number gets reassigned to someone like us, and Bergmann Cawley probably has no incentive to tell the debt holder that they are trying to collect against a person that doesn't have this phone number any more.

- janjust got a call from this company they asked me if I was who I was and I said yes then for security purposes they wanted to know my address and last 4 numbers of my social security after I refused to give them that info they kept repeating the same questions over and over and I kept telling them I wont give out that info until he told what this was about he wouldn't do that so finally I said Ill check and verify if this company is legit and he hung up
