Terrorist calling trying to get my number.  FCC should eliminate these people, they are up to NO  GOOD.  Call 15 to 30 times a day, use several different numbers, and NEVER leave a message.

Today this caller called me 3 times within 20 minutes of each other.

One of these times they called my on two phones of mine at the same time.

Their behavior today seems very aggressive. Leaves no message.

I have one bill collector that leaves a message saying: "This is a call from a debt collector and we are trying to contact (insert name here)."

And my voicemail does not identify me at all.

First, I thought that either I can sue them as one of the lines is a business line, and they are trying to collect on an account that the statute of limitations on collecting a debt has passed by 3 years ago.

I know this combines two issues, but the aggressiveness reminds me of another bill collector.

I can sympathize with you, except I am the one sick and disabled (Had a great career path working for a newspaper until I was paralized twice by bone sticking into my spinal cord).

They did that for me for months before writing me their first letter, which they are required to do first and wait 30 days before calling. This company also ignores the Florida Statutes that says a debt not collected after 4 years is No longer collectable and calls should stop.

I have written templates of letters: Cease and Desist calling me; I always request the records they have that claims I owe the debt, to include the original owner of the debt and past collection attempts, & if there were lack of interest in collecting or they fail to collect within 4 years after the debt is delinquent, then I tell them that the debt is too old by state and federal laws to collect, and cease and desist all attempts.

While I had two emergency surgeries in 2008, I lost 80 percent of my income, and I had a judgement against me. I looked it over and found out that it was a small credit card balance that was 10 years old, and since I spent most of 2008 – 2010 with MRSA Sepsis, I was sued and a summary judgement filed against me.

I filed an appeal saying that I was not properly notified, and that the debt was no longer collectable as per Florida Statutes and the Judge did not have the authority to issue a judgement when he should have known about the statute of limitations on debts,

Unless fraud can be proved, I demanded that it be presented or to reverse the previous decision and I ordered that the whole lawsuit be exsponged from all public records. The decision was reversed and was removed from both the court clerk's office and removed from all credit reporting agencies.

I hope this helps you. I can't remember what the exact statute is, but if you Google it, you will even find a post that shows each state's collection limitations.

    1. Demand the caller to provide you with everything they have on the supposed debt or claim against you (they are required under the Fair Credit Reporting Act to provide this).

    2. Review when it was first reported delinquent, and how old the debt is.

    3. If it is still within the statutes of limitations, send them a letter, as per the Fair Credit Reporting Act that as a third-party, you only will deal directly with the company who says money is owed, and they are to ceased and desist any and all collection activities. They are allowed to call you back acknowledging receiving your letter and some will tell you that you can be served and sued in court. I hang up on them when they start threatening anything except telling the original owner you will only deal with them.

    4. If the debt reaches 4 years old and you have not spoke with them, and you have not sent money to them, send a letter that according to Title VIII, FS 95.11(3), the debt expired after 4 years. There are exceptions including collection of taxes, or if real property is involved. This is the same statute (95) that limits malpractice to 2 years unless the act was fraudulant.

Since I also am a computer scientist, I have. written my own program that requires the input off data from the letter and when the original owner received your last payment, and it produces the letter. I had to do this because living only on 20 percent of my income, we had to allow the house to go into foreclosure, and only had money for food, electric and water. We reduced our package to basic TV and their basic Internet service, to keep getting emails as my attorney processing my disability required documents by email. We lost more income when the mortgage bubble popped, as she was a mortgage broker and lost her job when her company closed all its offices. This lasted almost 7 years (counting from 2007) until my surgeon wrote a letter to the court explaining why the two surgeries failed and how I got MRSA from a contaminated rod. I had a hardball sized cyst/abscess filled with MRSA and it wrapped itself around my spine at the surgery site.

I hope this helps, as I too went through this, and now that I am divorced, my paper's disability company waited for my divorce to hit public records, and I was told since I was living alone that I was doing everything my wife was doing, and I lost $600/mo. The insurance company never took into consideration that I was on Meals on Wheels because I can't cook, I have a certified service dog who can't cook or clean, but she helps me out around the house and is trained to recognize life-threatening symptoms, such as stroke, seizures, and being in a state of confusion, she runs and finds someone to help me. She is also trained to get my cellphone so I can call 911, and she is a big help with food shopping. If I have to use a push cart, she is hooked up to help me push it by pulling it, she helps pull a basket that I put groceries and pulls it up the stairs. She helps to put items in the refrigerator or freezer. She is trained to unpack bags for me, and with items like yogurt that goes in the bottom draw, she picks them out of the bag and puts them in the draw.

She helps me with breakfast by getting me a yogurt from the drawer, she gets my wallet, cellphone, house keys and her vest and if necessary her harness, and she picks up everything that either I drop or falls, saving me from bending. And she has just learned to help me unload boxes among some of the things my wife would have done for me, Daphne, my tri-colored black Australian Shepherd, is a strong dog and very smart.

None of this plus the person I hired before losing the $600/mo to do gardening work and my house cleaners which I can no longer afford.

Good luck and you both will be in my prayers for comfort and to help you to deal with the bad days. If he's like me, I can count my good days on both hands. And now I am facing a partial hip fusion due to bone growing inside my hip and it is approaching the illiac sac which if it does it can cut arteries, veins, or the nerves to my legs. I will never be as active as I was back in 2007, and my prognosis is not good. All I can do is enjoy the good days when they appear.

Received a call from what appeared to be a 321 area code and identified as an unknown caller.  Turned out to be a spoofed call from First National Collection Bureau located in McCarran, Nevada.  This was a debt collection call for somebody I have never heard of.  Interesting that First National's data base is so up to date that if the person they were looking for ever had the number they called, she would have had it over seven years ago!  Also, it makes you wonder why First National has to hide its true identity behind a local number.  If First National starts out by hiding behind a local number, it also makes me wonder what else they might be hiding in their collection efforts.
