    I just received a call from a man, didnt get his name, but he was very rude. He stated that I was being charged with fraud charges with a previous bank. He stated that I had 30 mins to pay $1600 or there would be a warrent for my arrest. He wouldnt let me get one word in, ask any questions, and spoke to me as if I was child. I just confused. He ended by saying, have a good day and good luck ..

    This is a long summary, but you need to read it carefully if you think you are being threatened by a debt collector.

    The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    * Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]

    * Debt collectors may NOT
    - repeatedly use the phone to annoy someone.
    - falsely claim that they are attorneys or government representatives
    - falsely claim that you have committed a crime
    - falsely represent that they operate or work for a credit reporting company
    - say you will be arrested if you don’t pay your debt
    - say they’ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so
    - communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
    - say that legal action will be taken against you, if doing so would be illegal or if they don’t intend to take the action
    - use a false company name
    - take or threaten to take your property unless it can be done legally;

    The debt collector may not garnish your wages unless there is a court order to do so.
    + Many Federal benefits (including Social Security Benefits) are exempt from garnishment

    You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000,

    Report any problems you have with a debt collector to your state Attorney General’s office, the Federal Trade Commission, and the Consumer Financial Protection Bureau.

    This guy called my phone too claiming i had allegations filed against me from the state of ms, regarding a "payday loan" that was supposedly taken out in 2011.
    claimed that i have a hearing tomorrow morning and  that i will go to jail for 90 days with a 4500 bond....
    I told him I read the reviews on him and his number and come to find out, they are a fraudulent company when you call the number back and it is after hours all it says is welcome to processing department, no name, no leave a message and we will get back to you or another number you can call or nothing...
    Be on the look out guys, this stuff is ridiculous.

    I had a phone call today telling me that my x-sister in law had listed me as an emergency contact and she needed to report to court with in the next 30 min. If she didn't that was a felony and she was already in trouble for a felony. He wanted me to get in touch with her and tell her to call his #. I asked where he was from and he told me Texas. I said that didn't make sense since she was in Michigan, Why would he be assigned to something in a different state. I asked him for his # and he told me that I have caller ID and have her call him and then he hung up!! So I called the # back to verify that the # was legitimate and the guy answered the phone. I told him her # was disconnected so I had no way to get in touch with her. He told me that they were in touch with her and hung up on me again. I googled the # 512-400-2637 and found he has been a busy man!! I am not the first person to receive this kind of call. Because I asked so many questions he never asked me for any $ to bail her out. KEEP A HEADS UP.....THERE ARE A BUNCH OF CRAZY PEOPLE OUT THERE!!

    A Mr. Bailey called twice this morning. I answered on second call. He said he was calling for a Cassandra. I advised he had a wrong number. He was very rude and said, "I know she's there.  She is going to jail if she doesn't pay debt." I advised him that there was no one here by that name, and asked to speak to his supervisor. He said he was the supervisor.  I finally had to hang up on the guy. What a jerk!

    Yeah they called me too , but they are not a collection agency , they don't collect money , it's not a payment center , those people are mad about what the situation is and blog to make them sound like collections . You have to go down in person to handle this and it gives you papers on your case , I got my case dismissed and it's safe , I've got my receipt . It's protected up to 50,000 dollars . A scam is something that's wants your cc info over the phone , I went down in person and got my case dropped , they gave me my papers on this as well . I thought wow scam but I went down to the location and got served papers , so I took care of it . Keep track of your checking .

    A man named "Joe Bailey" called and asked me if I was the emergency contact for "Jane Doe". The unsettling thing is, he did not say Jane Doe, he actually had my daughter's name. He said she was wanted on two felony counts in Iowa for not replying to a 10 day notice. Hmmm... my daughter has lived overseas for two years in the military. My husband joined me on the phone, when we started asking "Joe" questions he became very defensive, very quickly, and hung up when I said "Gee I think this guy wants money". SCAM. Will do what it takes to report this caller to the proper state agency in TX, or where ever "Joe Bailey" was calling from.

    Yes, I did. It's not a fake like I said they served me papers , I thought the same thing but I didn't pay the office directly . They aren't a payment office they don't care if you pay and that's why everyone is mad . You can't pass bad checks or drafts .

    Oh really? How did he help you? My guess would be that he showed you the way to the back door when fraud investigators were coming through the front door. Feel free to tell us your story though. While you're at it you can give us Mr. "baileys" actual physical address. We'll be waiting....

    Yeah, I'll bet!  "Firms" that are desperate to maintain their "privacy" always do so for a reason. No one here will have to think much about why "Joe" is doing so!
