It is the LAW!
If you record anyone, anyone at all you must advise that person you are recording that they are being recorded. They must also give you permission to record them. Note: if you are leaving messages on a Voice Mail or Answering machine you are now giving permission to whomever you are calling to record you. Recordings are not admissible in any court without permission or a warrant of the conversation through the courts. - harrass replies to Steve| 2 repliesI owe this payday loan company Moneymart from a debt from years ago, I get calls from them 10 to 15 times a day from multiple area codes I have already told them I am not paying I did the loan over and over again borrow 255.00 pay 300.00 back and re borrow over and over 45.00 they made off of me every 2 weeks and now they think im gonna pay them they call all the time what shall I do
- Tamianth replies to recordingsROFLMAO! That a lot of hooey on your part also! Not all states require it, each state is different. In mine, I don't have to say anything, I can record it because the law say's I can! I do not have to tell you anything.

Extortion Scam Related to Delinquent Payday Loans
Washington, D.C.
December 07, 2010 FBI National Press Office
(202) 324-3691
The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers. - ShillKill replies to recordingsBar number please! LS already has an attorney and I am sure s/he has advised LS about these recordings and their admissibility. Why would she need to take clearly incorrect advice from some shill dispensing legal advice?
But hey, maybe you can interject some doubt into consumers reading this thread so they can be further intimidated by this outfit? - DeletedMedia replies to recordingsOh, blow it out you’re a**;
We will record them, and do anything we want with the illegal calls, including posting them all over the internet. Play back on them- whatever Non-RL, SIT, DTMF, soundboard, wav file, cid burst, insult we want. We will record their voice, and cid algorithms. Any of them reading this- doesn’t like it? Bring it on. We the Consumer cant wait to see all about you, in front of a Judge. - 4Q2 replies to GunnarWTF is "OPPENINF"?

- MidNYteStorm replies to recordingsThe state if NY is a one party state and are not required to advise anyone that their call is being recorded.
- Elspeth replies to debt collectorThis shill probably won't be back to see this answer, however, the poster said she had proof that the debt the scammers were calling about had been PAID OFF! Then again, when have shills been known for having good reading comprehension!
- MidNYteStorm replies to SteveTelling somebody to call you is rather suspicious. I only hope LovingSister stays clear of your advice.
- Resident47 replies to recordingsWorry about your own rulebreaking. You WFG shills have been outed and busted repeatedly in this thread.
Last October in a related thread you also tried the same crap to confuse people about their phone recording rights.

Just so we can stop reloading the same argument every few months, linked below is a journalist guide to the issues of phone recording consent and a breakdown of everyone's options per state. In over three-quarters of the States, your protest goes limp.
http://www.rcfp.org/taping/index.html
Obviously, audible evidence of your use of the telephone as a weapon is the last thing you want people to have. How I lie awake nights dreaming that witless thugs like you would call my house and treat me like garbage while putting on a false drama about my supposed debt problems! I could not haul you and your cut-rate lawyer into a court hearing fast enough so that we and the judge and invited journalists can all watch and hear my clean time-coded recordings of your ridiculous extortionist threats, made quietly and legally in my single party consent state.
If I instead lived in an all-party state, I would long ago have maneuvered you away from an expectation of privacy and also prepared exquisitely detailed transcripts of all our lovely conversations. I might also mention the August 2010 appeals court decision holding that a secret recording does not violate the Wiretap Act when made with no malicious intent.
While you're whining to the bench about how you think I've denied your precious right to hide your sins, I'll be granted a judgment for your far worse trampling of my FDCPA rights to proof of claim and fair treatment. Give me a jingle sometime so I can make you clowns subsidize my rent and groceries for the rest of the year. - Hoss replies to Debt CollectorWow go to school get a real job with the right education you could do so much better than scraping the gum off of somebody shoe and call yourself a debt collector and yes you made the comment you're not all idiots you definitely are all idiots you lie and cheat to intimidate people that by definition make you all idiot's you can't be truthful and try to do your job you have to lie and cheat that makes you worse than somebody that Had the debt to begin with they either got hurt and we're not able to pay the bill lost their job not able to pay the bill something like that you're just an idiot for even thinking the worst about somebody to begin with the phrase shame on you comes to mind

- MarySG replies to Joe Di Paola| 1 replyDear Mr. Joe Diapola.....
You have a woman posing as an atty calling to tell me that I will be served by your company today for a debt. She resides in California, I am out of country. She gave me three different names of the corp. that is 'suing' me....I told her each time I had never had an account....why would I be being served? She said, "....if you paid your bills you would be sued!.."
I told her not to call me again....she hung up on me. I phone her back....she said ..."I will not talk with you".....and hung up.
I called a third time and she said..."I will give you 30 secs..." I told her to mail me the details of the "debt"...and confirmation thereof.....she hung up on me.
Funny thing: I am in the legal profession....the 'real' legal profession...and I know the different debt collection laws of the states....I intend on forwarding the transcription of the conversation to each of the States' Attornies' General.
You should really ck into these people that are bouncing your name around in such an unscruplous manner....possibly breaking the laws of many states. (that advise is free...you can thank me later) - tAYLOR fUSELIER| 1 replytHIS PERSON IS CALLING SOME OF MY FAMILY MEMBERS TELLING THEM THAT WE HAVE TO APPEAR IN COURT AND DONT WANT HIM TO MISS THE COURT DATE,BUT WE HAVE NEVER RECIEVED ANYTHIG IN THE MAIL. tHEY NEED TO STOP CALLING FAMILY MEMBERS AND SEND SOMETHING IN THE MAIL.

- CWG40 replies to tAYLOR fUSELIERThey are trying to scare you. If you have not received service of process in hand, they cannot proceed against you. These people do not specificy what court. That's because there is no court and no court date. They are trying to scare you.
If there is a valid debt than they must send you a letter specifying the debt and they must send it US mail. E-mail no good.
These people are attempting to scam you.
