- American JusticeSomeone called our son from 1-716-831-5601 and told him that they needed info about me. He said he was an investigator and there was a civil suit against me. This is not likely! Fortunately, he was smart enough to hang up on this person, and immediately googled the number for scam information. Then he let us know. There is a brand newborn in their house and this is definitely a disturbance of his family's peace. We won't tolerate this unwaranted and obviously bogus activity for criminal personal gain.

- StarI just spoke to ESR or "Empire State Recovery" and this just seems very suspicious. They had stated that there was a judgement against me from Providian and that I had "two choices"- settle outside of court by paying over the phone today, or if I "refused to co-operate" that there would need to be court proceedings. The funny thing is that when I told them that I was not familiar with this debt, and requested them to mail me the information, they refused! I told them that if I could validate this debt, I wouldn't have a problem paying it. They said that they could not mail it to me! They said that they needed to "get me out of this office" before the end of the month so that if I did not settle the debt within 48hours that they would file a court hearing. They put someone on the phone that claimed that they were a lawyer. Sounds like a bunch of crap to me! Why would a company want to spend the money to send a lawyer to court for a few thousand dollars before spending the $0.42 to mail out a letter first! I will not give my personal information and creditcard info over the phone without verifying that the company and the debt is legitimate. The scare tactic is not going to work with me!

They are a collection agency just like every other collection agency. If you read directly from their website, it states that in order for them to pursue litigation, they will need to obtain approval from the original company. So in my case, Providian would have to agree to pursue litigation. The determining factors being the Balance that they are trying to collect vs the cost of litigation. We all know that litigation is not cheap. In the case that it would ever go into litigation (which is rare), they would have a very hard time collecting the debt if it was too far in the past. Find another job if you like to hlep people go to consumer credit which is actually a respectable agency, but when you harrass people for money and refuse to send an "Item of Particulars" and say that you can look at them in court, thats against the fair credit act.

They are a collection agency who buys old debts from companies for pennies on the dollar. Then, they call and threaten bodily harm, threaten a raid from the SWAT team and your drivers licenses and bank accounts to scare you into paying the original debt, their outrageous fees and court costs that they never even incur because they don't even take these cases to court. Oh, and they also pretend to be attorneys or paralegals from a Law Office, thinking that will scare you even more. Valid debt or not, that is harrassment. So, if I owe a bill and can't pay it, the law says there is no punishment except for bad credit. These people break the law by stalking and threatening. The bad guy here is the companies lending to people who are already in devastating financial situations and charging extremely high amounts of interest knowing they won't get paid on half of it. Does it make it right for someone to skip out on a debt...no. As a matter of fact, I had a debt for a cash advance I needed several years ago. I couldn't afford to pay it back and it went to a collection agency. I offered to pay it back by sending them a money order or through western union, and they declined. They would only accept the payment if it was through my bank account. If I am willing to pay a debt, why can't I send a money order or go through western union? These places are scamming people. If my original debt wasn't with them, why would I give them my account info now....4 years later?
- investigatorI received a call from 716-831-5601, she stated her name was Mrs. Brown and that she was an attorney with the Law Offices of Empire State Recovery. She said that I refused to pay in Los Angeles and now I will be summoned to New York. She said I had a cash advance loan for $420 and that if I paid today, she will forego the court fees of $2450 and take 2 payments for $210. I said I had no idea what she was talking about. She said all of my bank information shows active and that she will get a judgement against me to garnish my wages for up to 25% and seize any property in my name. Again I asked what the debt was from, she never gave specifics. I asked her if I could get a copy of the debt, and if I found it to be valid, I would send in a money order or pay by western union. She was firm in saying that she "had to have my bank info" to get a payment now. I told her I didn't have a bank account (even though I do) and she then said that the police would be by today to serve me with a warrant for my arrest and that the matter in question would be in the Los Angeles Court. I asked for the case number and for the phone number of the agency that would be arresting me so that I can give them the recording of this call. I told her all calls on my cell phone were recorded. She hung up.
Then, I called the number back, spoke with an operator who said "who is this", I said I missed a call on my cell phone, he asked for my cell number and I gave it to him. He couldn't find it in the system, so he needed my social. I said no and asked if this was a Law Office, he said no he was a special financial investigator for the state of New York. Cases go to him when people are about to be served with warrants. I called him a liar and he called me a b**ch.

IF YOU PAY THEM ANYTHING OR GIVE THEM ANY ACCOUNT INFORMATION, THE DEBT THEY CLAIM YOU OWE WILL BE CONSIDERED LEGITIMATE AND THEY CAN TAKE ALL OF YOUR MONEY OUT OF YOUR BANK. - Jane replies to WHAT A SCAMEmpire State Recovery called me in January 2008 stating a lawsuit if I didn't pay and b/c I was purchasing a home, I went ahead and paid the $4500 I owed on an old Chase card. I received a letter stating my account was paid in full from them. Fast forward to June 2008 and when I finally started the loan process to purchase my home. My mortgage broker pulled my credit report and I still owed the $4500 except to another collection agency. To make a long story short, I ended up paying another $5000 at closing to purchase my new home. I called Empire State Recovery and they said that b/c I had settled it w/them it wouldn't show up on my credit report..which is a LIE. I have been on the phone with the 3 CRA and confirmed that even if ESR owned my debt it should be listed on my credit report and when I paid for it, it should also be noted on my credit report. This was NEVER the case. I'm now speaking with an attorney. So please to everyone out there...if ERS calls you, don't settle anything.
- Jane replies to mommas girlRead my reply previously and just don't settle. They used the same tantic on me and I gave in b/c I did owe on a previous Chase card and was going to purchase a home. Obtain a copy of your credit report before speaking with anyone from ESR because if they own your debt now, it should be listed on your credit report. Also speak to your previous credit card company and ask if they sold the debt to ESR. In my personal experience I wished I had known these steps before and this site.
- fabulous99I have been harrased at least twice a year for the past 9 years about a account that was settled 10 years ago. The company I paid off went bankrupt and sold all there accounts to another company that went bankrupt and sold etc. Yall Get It any way....this guy threatens to charge me with theft of goods and fraud and have me arrested within 3 days if I didn't pay up. I gave him the name and number to our local board of collections asked him for his name address, direct phone number, and fax number he refused to give any of these. Got loud and even ruder after I told him the name and place of the collection agency I paid off in 1999. And told me he would process the warrent and have me picked up. This guy really annoyed be after sighing in the phone like I was annoying him, and I told him that was not called for while I was cooperating with his questions. He then explained he had been in a car accident, lost his leg and was changing his bandage at that time. I told him may God have mercy if he was lie-ing that it don't happen for real! I have a lawyer already from 4 years back that will getting this recorded conversation tomorrow.

- Not a thiefI was called today and left a voice mail threatening to get an arrest warrant against me. I have it saved to voice mail so the employee of ESR who said their company does not do this is wrong. Perhaps that employee does not but others do. I am being contacted about a debt for a Discover card that was obtained by my ex-husband in my name while we were still married. I spoke with "inspector Allen" who when asked if she was threatening to have me arrested transferred me to one of the "attorneys". Although this attorney gave me her name I did not have anything to write it down with and do not remember the name. When I asked her if she was threatening to have me arrested she said yes - Sherriff, handcuffs, jail and all. When I pointed out that a person cannot be arrested for a past due debt she told me that Discover card is pursuing me for bank fraud. I will be contacting an attorney tomorrow to have this matter handled in court, not only do I not have to pay for this debt I do not owe but I can also file litigation and seek damages for the threat.
By the way - I called Discover card and they wrote off and sold this account in May of 2001 and are not pursuing me for bank fraud.- Caller: ESR

- The GI have a house phone for an emergency line. Never gets used. Earlier, a "Leslie Clarke" who identified herself as an investigator called the number looking for my boyfriend's ex-wife. She said that the ex gave this number, MY NUMBER, as a contact number. We found out this was a lie, along with every other word she uttered. I am not exactly sure how these people got MY NUMBER, but I sure don't appreciate it. The ex did get in contact with them, so they shouldn't bother me anymore, but it absolutely infuriates me to NO END that these people called my home looking for my boyfriend's ex!

They told me and my parents that they were having me arrested for "BANK FRAUD" and that they issued a warrent for my arrest. They also left a voice mail from a woman who said, "she was an investigator, calling to have me arrested for an arrest warrant her company issued". WTF? Who do these people think they are. The bad thing is, I don't live with my parents, I am 30yrs old and I have never heard of the debt/credit card they say they are collecting on. How do these loosers sleep at night, let alone get away with doing this. What can I do to get them to stop calling me and more importantly, my parents? I have contacted an lawyer and I am going to sue ESR. I don't know what else to do?
