- Fred, Esq.For anyone trying to collect an old debt, they may be barred from suing you due to the expiration of the statute of limitations. For example, in NY its 6 years. Therefore, if the last payment you made on an old debt was over 6 years ago, just tell them nice try but they'll get their butts thrown out of court if they try to sue. The best defense against these morons is a little information.
Note, however, if you make even the smallest payment at any time during that 6 years, the statutory time starts all over again. Also note that although you cannot be sued beyond what the statute of limitations provides, if the debt is yours - it remains a debt and may remain on your credit. You just can't be sued. - MichaelI received a call from these people a couple of weeks ago... As soon as I answered my cell phone, my battery went dead. (No idea how they got my number in the first place, the phone isn't even in my name).
After plugging in my phone, I discovered a voice-mail saying simply that I would be arrested within 24 hours. Completely shocked, I called the number back and got Ms. Leslie Clark on the other end. She told me that I had an unpaid debt for a visa card for 2000 dollars.
I tried to explain to her that my ex-wife was supposed to have paid the card off.
(Back in 1999-2000, I found that my ex had been using my card at ATMS and using the cash for dates to cheat on me....the card WAS in my name, but we divorced, and she said that she would pay it off. Since then, my ex disappeared to the other side of the country and re-married...I don't even know what state she lives in now or what her last name is.)
While trying to get those few sentences out over the phone, Ms. Clark interrupted me every time I opened my mouth. After finally explaining to her that the news that I still had a debt was 'NEWS' to me....Ms. Clark called me a lowlife and said that it was no wonder my ex had cheated on me, that my 'file' was in a stack for immediate litigation and that I would be dragged from my house in handcuffs the next morning if I did not give her my check or bank information. I told her that I would like to make a couple of phone calls for information, and asked if I could get back to her the same evening, and she refused, saying basically it was now or never...either give up my info immediately or go straight to jail.
These people scared the living hell out of me, and told me that they would be taking 85 dollars per month for the next 30 months or so out of my account starting next month.
After reading all these posts here, though...I am canceling my bank account tomorrow and am going to block their number from my phone.- Caller: ESR

- dixie replies to Too-late| 1 replyThey just called my mother's house and spoke to my 14 year old sister. She called me all freaked out because an "officer" called looking for me. I haven't lived with my mother since I was 14 years old. She and I don't have the same last name. I have never, ever used her as a reference on any kind of application. I have very old debt that should have fallen off of my record, and nothing else. I have no idea how they would have gotten her phone number. Thanks for scaring my sister, scumbags.

- phonedudeNJWell let me share my phone call with these crooks - First of all, "Inspector Alonzo" calls and leaves a message with my 12 year old son, saying "You better tell you Dad or Step-Dad that he is being fully investigated and unless he wants the police there he better call me tonight" - What kind of S***bag is this Alonzo? I want someone at ESR to get in this forum and answer the question! I know the rules of collection agencies and this is against the law. I called back, gave my "case number" and said "You talked to a 12 year old - how dare you - now I'm not saying anything else but you need to send proof via mail" - and I hung up. They have never sent nothing by mail. They are s***bags - Just like all collection agents - they are hired for thier b*tchy and C*nty attitudes - I was pulling cables one day at Payco America when it existed back in Edison NJ - and I was in the office of one of the Managers and a supervisor came in and said that they had someone on the phone and had them "all worked up" and needed a push - He said "Give it to Christine, that c*nt know how to get the job done. Nice talk about your employees. Collection agencies are the scum of the earth. Know your rights - don't deal with them

- KyJoe replies to Innocent BystanderThey called my house saying that "someone had filed a complaint" in their office against my wife. I picked up the phone from the machine and the guy couldn't even pull up any information on his computer, which had suddenly gone "down". He sounded like about a thirty year old African American gentleman. He switched me to a younger-sounding African American woman. Neither identified themselves. I got a shady vibe so I instructed them that any further correspondence between myself and them was to be conducted only through the US mail and to never bother my family again. That was yesterday... we'll see.

- janice replies to auntieskepticinteresting story, anyway I have a friend and she is willing to pay 20 to 60 dollars to have someone to go to three different houses and scare these people. She is wondering does anyone knows anybody that can be a ruff neck or in a gang, if so she wants someone to go to this address 6050 S Western Ave Apt 405 Los Angeles, CA 90047, she wants someone to call 3237528132 and threaten them over the phone
- Deland M.Empire called my wife about a 2 year old $200.00 debt. after they threatened her with criminal charges of fraud she gave me the phone. I asked how much it would cost to settle and they said that they'd take $160.00.in one lump sum.Well the caller stated that they recorded every call and I said that was good and that I had that app to and I also automatically record every call.
Well my brother was there and they had contacted him first and he said that the guy I was talking to was very rude to him, so I asked him why he was so rude to my bro and he said hed see me in court.
Two hrs later a woman called saying she was with the hardship dept to set up a payment plan to settle the debt I asked her what was her name got it then asked the companys name and address she was with and she replied that I was being hard headed and if i wanted to know to look it up myself and that she'd put me in as a refusal and hung up.
I took her advice and found out all their info and that they used illegal intimidation practices.I called back and got the same woman. i told her all the info i'd found out about the company and she now gave me a different name for herself,I called her on her lies and asked for a supervisor. I told him about how the first guy threatened criminal charges and that it was illegal. His response was that he was in compliance, I said no the hell you aren't your guy (christopher) broke the law and that it's nothing for me to go downtown with$100 and file suit against them because I also automatically record all calls ,there's an app for that, and what they are doing is illegal. His response then was what do you want to do about this, I said you're going to put the debt down as paid in full.He said he'd put it as noncollectable. I said no paid in full or I'll see them in court,he said ok and that we'd never have a problem with them again and he'd have a talk with the guy who threatened my wife cause there not supposed to do that.
My point is don't be intimidated by these criminals, if they are breaking the law you have the upper hand.- Caller: Empire Recovery

- BigAYou could get a lawyer to sue them on a contingency basis in Federal court which is the proper venue and get a lot of money from them. You handled this completely wrong. These crooks will simply sell your name and debt to another crook. Always make a debt collector follwo the letter of the law. Which is:
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
Read up on your rights here, get template letters to send and also make a complaint at this government site: http://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.
