***A company must be licensed in their state as well as the one they are trying to collect in if two different states are involved.
Some Tips:
*Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time, date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

- Matt! Matt! Matt! replies to mattLooks like you will be out of a job soon, because your boss lost an 82 million dollar case. Then bill collectors will be calling you, oh the irony of it all! Love it. Then you will be one of those people taking loans out with no intention of paying it back, because your unemployment check won't come close to paying for that stuff you shove up your arm to get high.
- 731-256-6444this pathetic company keeps calling my phone for a debt that is not mine. Since they will not stop calling me im about to make it fun for their company.

- Resident47 replies to mattTypical shill blindness to facts .... You cannot assume that Angie knowingly exploited a lender operating illegally. An online or payday lender would be exactly the type to mislead borrowers as to its own authority to do business in a given state. It's not Angie's fault that a lender was too crooked or cheap to obey the same commerce laws its peers respect.
We've seen this game already from the "Indian tribal authority" payday lenders who behave as though laws don't apply to them. The FTC and sane judges rule against these frauds every time. They don't waste time scolding borrowers just because "they took money and didn't pay". The bad businesses are forced to eat those loans as part of their punishment.
A trashy debt buyer like PRA is also liable when it tries to enforce contracts for those invalid loans. PRA can and should be sued for insisting Angie owes, and in an abusive manner besides. Now, do we finally have that clear or do you need a judge to explain your boundaries? - Resident47 replies to shannonLinks to FTC and CFPB resources were provided on this page weeks ago. Please stop misleading the public with your half-baked misunderstanding of the law you're describing.
The 'F' stands for "Fair", not "Federal". The $1k statutory award is not per violation, it is per action in court. The $1k is a cap, not a minimum. The amount *demanded* can be higher if a plaintiff has actual damages. Defendants are also known to pay more in quiet settlements.
Winning plaintiffs should not have to give up a split from what they are personally awarded. Rather, the FDCPA has a unique cost-shift provision, forcing losers to pay all legal costs incurred by plaintiffs.
FDCPA § 1692k. Civil liability
http://www.law.cornell.edu/uscode/text/15/1692k - Resident47 replies to KellyHere we go again ... The whole point of an original creditor dumping off assets to a debt buyer is to make a fast and cheap return and never think about those accounts again. If you return to the OC post-sale, it doesn't need or want your money to "settle" anything. Your fight is with the buyer, which will likely not have a scrap of proof you owe. Puts you in a much better position to bargain or fight, yes?
- Mike replies to daracaraThank you very much for your trouble! I'm blocking them all now.

Just got a call from them. I never answer unknown calls and I don't block them because it's a waste of time & space. Unfortunedly, we owed Sears credit card for paying airplane fares for my daughters to their grand mother's funeral and instead of bugging us after slow payments we agreed to sign a note to them and it was added as additional income at the end of the year and we paid taxes on it. Sears although out of money, wrote it off as a bad debt. If you think that leaves a pretty taste in my mouth, you are wrong..however I am thankful to them and more than likely they'll never give us credit it again.. But if this is the debt that portfolio recovery is after.. I can deal w/it. - Traci Stuckey830 AM and they are calling my phone. I work at night and sleep late the next day!

- Kalme Willow replies to daracaraThank you... I have at least this many numbers blocked on my phone over the past month. I just got one from one of these numbers that said someone was calling from the Davidson county jail. I called my family and made sure everyone was safe. We are nor near Davidson county so when I searched the number... I was directed here. And yes... I get constant portfolio recovery calls . this was the first time for this number. This is also the first time I've saw them pose as someone else . I'm sure they were thinking I'll answer when they call again from the jail. Thank u for this site.
So many weird laws being made now... Wish someone would turn off their phones. - El JefeCalled and asked for El Jefe, I then stated "that is I", they went on to ask if I was circumcized! WTF?! They went on to say they were doing a survey. I immediately hung up on them.

- AMJust got a call from 731-256-6444, called himself portfolio recovery, however, their number is totally different. I asked him how he got my number and of course, he avoided how. He wanted me start paying a debt from 2001 of $500.00. I told him I don't know how because all my money goes for me to live. I gave him my attorney's name and told him to call him.

Look here, you moralistic [***].... IF you had actually read your bible (because you likely CLAIM that you're a Christian) you would know that usury is immoral and against scripture in all the Abramic religions... and that there's something called a jubilee which exists/existed for a valid reason and is the basis for our bankruptcy laws.
