Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.

After I called this number back it was immediately apparent that this is but one of many (perhaps hundreds) of telephone numbers attached to Portfolio Recovery Services. Portfolio is a bottom feeder in the collection industry which (typically) buys bad debts from other companies for, literally, pennies on the dollar (i.e. for a $1,000 bad debt that they buy from “XYZ Bank” they may only pay $10 or less). In their defense, I will say that this is understandable given that, since the debts have already gone uncollected for some time and deemed “uncollectable”; the chance of recovering any of the debt from the debtor is slim at best. This is also why debt collectors like Portfolio tend to use tactics that are not always in conformity with federal or local law!
Now, I’m all for people who legitimately owe a debt to pay their debt but before you reach any agreement with Portfolio (or any other collection agency) keep the following rules in mind…
1. NEVER, NEVER, NEVER, NEVER give a collector electronic access to your financial accounts (be that a checking account, savings account, debit card, etc. If you pay them anything, do it by money order, one-time use debit card, or some other method that does not allow them to take money out of your accounts.
2. If a collector pressures you to give them electronic access to your financial accounts REREAD RULE NO. 1 ABOVE.
3. Before you pay ANYTHING make sure that the collector who is calling you has the legal authority to collect the debt. One way to establish this is through what it called the debt validation process.
4. GET IT IN WRITING – IF IS IS’T IN WRITING IT DIDN’T HAPPEN. When talking with a collector by phone don’t take anything they say at face value; even if the person you are working with is being honest with you don’t assume anything. That means that if you and they reach an agreement for you to pay all or part of a debt make sure that agreement is in writing and in your hands BEFORE you give them a penny. IF IT ISN’T IN WRITING IT DIDN’T HAPPEN!!!
5. If you do decide to pay a debt collector for a debt keep in mind how little they paid for the debt and negotiate accordingly…if you pay any less than the full debt you MUST get a settlement in writing which says that paying “$x” amount satisfies the debt in full and relieves you from the remainder of the debt…keep this piece of paper FOREVER.

- JoePortfolio Recovery a collection agency. Calling to collect on a debt that is 8 years old. The statue of limitations ran out after 4 years and it was off my credit report after 7 years. But still they call. Look up the statue of limitations for your state. If they call after that, don't answer. Forget out them.
