- Deltona Lawyer replies to SPDSue them locally. You have the right to sue them close to home. You can still sue them for violating a federal statute. While you are at it, sue them for violating the Florida Fair Debt Collections Practices Act which mirrors the federal statute, but is more debtor friendly. Read both statutes.
If they sue you, make sure you read the FLORIDA rules of evidence. They are required to have a records custodian testify to the accuracy of their records. Many times the debt has been sold several times. The argument would be that they are not the original creditor, so there is no way that they can verify that the debt is correct. GOOD LUCK.
Lastly, use your law libraries. You as a taxpayer are funding them and they are little goldmines of information. Each county should have at least one. - Deltona Lawyer replies to SPDI forgot to add that if you do get sued and the creditors have been doing things they are not supposed to do, you would have counterclaims. I have seen creditors drop their case because of the number of CREDIBLE counterclaims.
A person may actually owe the money, but due to the actions of the creditors may not have to pay it. I am all for paying bills, but the creditors have to be held to a certain standard of professionalism.
In court I have seen good honest people break down due to the unscrupulous harassment.
There is also a statute of limitations. The callers will talk someone into making a small payment just to keep them on the hook. For instance, 4 years goes by without a payment and the statute of limitations is about up. The creditor sweet talks the person into making just one small payment of $20. If the payment is made, the clock resets and you have to wait another 5 years for the statute of limitations to be up. - ms. rodI kept getting calls from a private number. i figured they were trying to sell me timeshares. I answered by accidentally, and was greeted by a kind gentleman named Clyde Thomas. He explained the purpose of the call was for past student loans. we set up payment arrangements and he went through everything with me in detail and answered all my questions. I'm glad I was called by this gentleman and not some of these other freaks. Glad I answered that call I can finally sleep in peace knowing I'm finally on the road to pay my debit. Thank u Mr. Thomas

- very strange| 1 replyThis was very strange. I got a message, with my name, so I contacted them. I had no idea what they were calling about. They said that it was in regards to my defaulted student loans through Kaplan. I have never attended Kaplan, and what students loans I do have are definitely not in default. He apologized, and said that they must have the wrong person. I said, now wait a minute, you called and asked for me BY NAME - if there are student loans out from Kaplan in my name then I need to know. He told me not to worry about it, that if I had never heard from them before and I don't receive anything in the mail then they must be contacting the wrong person. Sounds to me like they just randomly look for a persons name and call everyone with that same name until they reach the correct person. Very shady IMO.

- buggrit_1979I don't answer the phone if I don't recognize the number. Instead, I google the number to learn what I can before returning the call. I found this page, read the comments, and laughed, because we don't have any unpaid debts at the moment. So I call back.
A really bored-sounding, mush-mouthed man answered.
Me: Hi, someone from here just called my phone.
Him: *long pause* Someone called your phone?
Me: Yes, and I'm returning the call to find out what it's about.
Him: *long pause* Okay... give me your phone number and I'll try and look that up.
Me: [gives number]
Him: *long pause* Oh... is this [name that isn't mine and is no one I've ever heard of]?
Me: No, and whoever she is, this hasn't been her number for at least five years.
Him: *longest pause yet* I'm sorry ma'am. I'll take you out of our system.
I understand. I'd get high before/during work too if I had a sh*t job like that. But it was kind of hilarious.

TODAY I ASKED WHO THEY WERE AND TOLD THEM IF I GET ANOTHER CALL FROM THEM, I WILL CALL THE DA AND WHOEVER ELSE I CAN TO REPORT THEM FOR HARRESSMENT! THE LAST NAME OF THE PERSON THEY WERE LOOKING FOR DID LIVE AT THIS ADDRESS EONS AGO AND MAY HAVE BEEN RELATED TO THE ONE THEY WERE LOOKING FOR I HAVE NO IDEA.

They keep calling and I keep telling them I AM NOT THAT PERSON, THIS NUMBER HAS BEEN MINE FOR 20 YEARS AT THE SAME ADDRESS, and ask them how they got this number but they won't say. I also keep telling them NOT TO CALL AGAIN, and they tell us "we will write that down". Today I told them never to call again and that we would report them to the DA!! Bad enough to get all those political calls!! We haven't even co signed any loans! We have never had bad credit! I checked their number and they are who they said they were. Isn't there something that can be done?

No way to let them know that person is not there through the phone message. Called the number that showed up 303-731-0953 (Aurora) Told them that person does not live here at this address or at this number. Lets see if the calls stop
