- Trice M| 2 repliesI just experience the same thing with Bass & Associates P.C. They told me that I owe loans, I only owe one loan from 1989. And they told me the Department Of Education has placed my loan is in default. Mind you I'm a full time student just graduated with my Associates and currently going for my Bachelors. If your in scholl you do not have to make payments until you graduate. They told me that I had to pay full payments or I can't continue school. Also they gave me this fake number 1-800-621-3115 saying that it was the Department of Education. Its really sad how these 3rd party collection agencies are out here taking from the one's that don't really have. I've been paying a collection agency prior to this situation called Transworld collection... I've been paying them 5 bucks a month for 50 a month for years and then 5 bucks a month for years, now i found out a Judge put a restrainting order against them and they are no longer able to provide or should I say seal from folks. I searched the internet and found a forgivenesss program number and they put me down on collection agencies who are 3rd parties just trying to get your money...and increase your payment by thousands more than you owe. They only know your name and maybe your address which is easy to access from the internet.. they follow the rules when answering the phone like the Department of Education and ask for your SS which most of us gave, and thats how they get our updated info on loans etc. They work wilth other companies to gather your info. They pressure you into making full payments or big installments that you can't afford even try to influence you to reach out to family and friends to help you pay. Sobefore you give your personal info make sue its the direct epartment of education... and not a Collection Agency or a 3rd party acting as the Department of Education. Since I know there is a active restrainting order against the folks thats been collectig my money i'm going to sue them. Shame on them. So I called1-800-211-7984 and they brighten my day, told me my loan is in good standards and not in default. Told me that according to the Federal Data Base i'm a flltime student and i'm fine.Be proactive in your education and don't listen to what people tell you. Research things your unsure about because thier are folks out here to get richer and make you poorer. Good luck with this battle of long term burdens of these decades long loans that most of us don't evenhave our license within that field. Hopefully a change will come. Meanwhile stay away from loans there are so many free programs, grants, and financial aid.

- Janet| 1 replyIt appears that the Dept. of Education is using collection agencies to obtain payments on defaulted student loans. The forms I received had several different numbers and address to send information which makes the process extremely confusing. I have been contacting US Dept of Education since Sept. 2017 to set-up payment to rehabilitate by debt and each time I call they say they will mail forms for me to complete the process. Well today my bank account was emptied out. I have called several different numbers and 1-800-621-3115 was provided to me as the collections agency handling my defaulted loan. If you get a call from this number, they are real. I have at least three different numbers to contact to try to cure my debt. It is extremely frustrating. I owe the debt and have been trying to make payments. Good luck guys.

- BigA replies to Trice MYou will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
