- poconomokiI was googling Apothaker & Associates to see what makes them tick. Low and behold I'm starting to pull up cases and docket numbers all filed here in PA for a federal statue on consumer credit. One of the cases has the plaintiff's attorney. I'm sitting here wondering if I should contact the attorney. She did leave a phone number and email.

If you are not _____ _____ then disregard this message. If you are _____ ______ then by listening to this message you are acknowledging you are ______ _______. This is an attempt to collect a debt. Please call BLAH BLAH BLAH."

They have been told there is no one in the household by that name, yet they continue to call.

- JenniferThe caller told me that she was from a law firm. However, when I asked her if she was a "collector," she said "yes." She told me her return # was 1-800-672-0215. I had to request her extension.
The woman was very abrupt and short with me. American Express retained her firm BEFORE 30 days had elapsed from the date I received a letter from an earlier collection firm. I had responded to that firm's letter within the 30 days it gave me to respond. My letter should be delivered tomorrow.
The collector wanted me to tell her what I wrote to the prior collection firm. As I hesitated, she told me that she could find out what I wrote. I told her to do so. Because I was not responding the way she desired, she quickly told me she was going to file a lawsuit against me. Then, she ended the call. Big deal.
These collectors have ZERO interest why a great paying customer stops making payment all of a sudden. Personally, I am unemployed and have zero assets other than an ancient car.

- mrcA little note of warning I have been sent a summons from Apothaker dont play around with them at some point they will file a law suit especially if its worth persuing ie high debt.What you need to do is tell them you are recording the conversation very important make sure you let them know you are recording it. you cannot record someone without permission That way if they talk to you again like that you can sue them.know what your rights are with these bottom feeders. They count on the fact that most people panic or hand info over to them. they cannot say things that are threanting and no collection unless they are attorneys can threaten law suit . learned this from an attorney. at some point you may need a consumer attorney You are right they dont care I have 4 kids and no job . ps he is a lawyer out of nj

I used to be a collector for other agencies. They can threaten all they want to attach your wages or your disabilty or ssi or unemp but the law says no. Now where they can get you is levying you bank account. Kinda ironic, they can't garnish it from a check but they can go into your accounts to get it. My advice, cash and money orders. - Concerned| 2 repliesWell I heard a vicious rumor that Apothaker sues harmless people over old debts. I called my credit card company and they said my debt was charged off. Apothaker has no right to collect charged off debt. If I could afford to pay, I would. Theres no reason to sue defenseless people on hard times. I cant even afford my cigarettes, cable, phone, internet, by time I pay all my bills I dont have nothing to even go out and have some fun!

- Wire replies to Concerned"Charged off" is an accounting term. It means that the original creditor wrote the debt off as noncollectable and wrote it off for tax purposes. "Charged off" does not erase the debt that the debtor owes, it just means the original creditor is no longer pursuing payment. The debt can, and often times is, sold to a collection agency. So, if the Statute of Limitations has not run out on your debt, you may still be responsible for it. Sorry, hope it works out well for you.
