- Resident47 replies to K. MarieLet 'em hire Weltman, just so you can upset that winning streak. WWR will hire some puppet lawyer in your state if they aren't already licensed there. Let them all explain their FDCPA violations to a judge and why it was necessary to hassle you for what should be a dead issue.
- Resident47 replies to DonThe FCC lacks jurisdiction. You can take your gripes about this original creditor to the CFPB, FDIC, OCC, and attorneys general.
- Resident47 replies to SharonWhen did you plan to correct Comenity? Broadcasting your complaints here won't get that done.
- Resident47| 2 repliesComenity Bank / Comenity Capital Bank, parent Comenity, LLC, are subsidiaries of Alliance Data Systems in Columbus, Ohio. Its former names were: World Financial Network National Bank / WFNNB / World Capital Bank.
Comenity fka WFNNB has been the underwriter for a seemingly endless number of retail credit cards. Before you start screeching that you "have no business with" the bank, look at the backs of your store cards for these bank names.
Comenity was busted by the FDIC in September 2015 for deceptive payment protection and debt cancellation add-on products. Under both names the bank has been bucking to get spanked for hostile debt collection practices and runaway skip trace calls. The problem is that most people lack a paddle. Comenity's actions would be sufficient to attract many FDCPA plaintiffs except for its exempt status as an original creditor. Your best hope is the fortune to live in a state, like California or Florida or Pennsylvania, with similar laws to control a bank's in-house collectors. You may otherwise find shelter under ordinary harassment codes, though even there you may find inconvenient exemptions for certain businesses.
While a judge may not help, it's not to say you should take any abuse quietly. I'd say the first stops in your complaint tour should be the CFPB and the FDIC. Next can be the Ohio Attorney General, currently Mike DeWine, who has been fairly active in consumer protection. You can also try your own state AG, and then the Office of the Comptroller of the Currency, though I expect OCC to sit on their hands as they did during the mortgage mess. As ever, I repeat my advice to make Certified Mail your friend and send written complaints to Comenity directly. A paper trail you can prove will ease any effort to escalate your disputes regarding wrong number calls and unfair and deceptive collection tactics.
For those who enjoy details, it's been alleged that the "bank" is not a bank according to SEC filings but a servicer, the front desk issuing all those retail store cards. Possibly this means it technically does not own the debt it collects on, given the way card debt is so heavily securitized. This opens a different path, admittedly lumpy, for the intrepid to litigate against Comenity and/or its hired attorneys, possibly bending to FDCPA coverage. - Flicka replies to Aunt DebIt's Comenity Bank...
- Flicka| 1 replyI have received 4 calls so far from this number from different people identifying themselves on my vm as 'specialist' so and so, asking me to have my lawyer call them before they take their 'action'....whatever THAT is. They come across as 'restricted' on my phone and their messages purposely try and sound like they're from a legal office...that kind of 'tone'... asking for my lawyer to contact them or if I don't have one, well... I better do it before they take action. Hahahahahhaaa!! On the off chance one of you 'specialists' are reading this listen, I didn't fall off the turnip truck yesterday and you can kma...when I get a job that pays anything, I'll call you. Do you think most people LIKE not being able to pay their bills? Do you think I'm going to pay you anything before I feed my son or keep gas in my car and the lights on? Tell me, how low do you have to go to call desperate people up, day after day, and torture them for a bank? Living large on that black money commission...I doubt it.

- Fed up1-800-695-0978 has called me several times back to back, I do believe this is called harassment. . They left a message that they were specialist broachin and they have appointed an attorney for me. I have a app on my phone that usually picks up on who the caller is, and this one, does not. We have been advised of phone scams in our state.
- Resident47 replies to FlickaNot a bother. I first noticed a few years back that people were very confused about their rights and standing to dispute some ugly practices from this bunch. Since then I've been sporadically collecting crib notes. I'm only sorry I have to keep hauling them out and writing updates.
- Resident47 replies to FlickaIt's established that Comenity is a bank (or the empty husk of one) and not a law firm. You may have FDCPA causes of action in the following scenarios:
- The "specialists" are third party collectors spoofing the bank's number and/or posing as bank representatives.
- The "specialists" are posing as lawyers and/or making empty threats to litigate which would fool the Least Sophisticated Consumer.
- The "specialists" strongly implying if not claiming to be attorneys are in fact Comenity's in-house collectors.
See, the FDCPA demands that anyone in the business of collecting debt should do so under one true name. Third party agencies can't rename or falsely name themselves at will when contacting alleged debtors. Original creditors lose their exemption the moment they pull the same aliasing stunt, "which would indicate that a third person is collecting".

- Resident47 replies to MPReally? Comenity the bank is the same as Overstock the online retailer? The hybrid company is owned by Alliance Data Systems? Want to show us the registration?
- Resident47 replies to JanetA threat of litigation does not make its source obvious. Nor is the threat automatically illegal.
- Resident47 replies to LynnTry again in English that you were taught in school.
You can't make a decision without being certain of who called you. This thread demonstrates why "your milage may vary".
