I am filing a complaint with the better business bureau
- Fogarty| 1 replyKristin,
You do NOT have to take this abuse, and they are breaking the law, by threatening litigation they have NO intention of taking, as well as talking to third parties about your debt:
§ 807. False or misleading representations [15 USC 1692e]
A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.
§ 805. Communication in connection with debt collection [15 USC 1692c]
b) COMMUNICATION WITH THIRD PARTIES. Except as provided in section 804, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than a consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector.

Regards and if anyone will find who hides behind it please let us all know - Margaret replies to Linda| 1 replyCBB in Monrovia, CA is a ruthless collection agency with the rudest people I have ever met. Beware...without notice, they have frozen every penny in our bank account and forced checks to bounce (including our rent) which we will have to pay for, plus bank fees. After paying $100/mo for over 8 years, the principal was never paid down one cent, and the interest kept increasing. I will be dead before it is paid off.
- being harassedI, too, have had very bad experience with this collection agency. I am unable to pay my bill at this time do to financial hardship. I believe that this collection agent calls and hangs up not leaving messages since I have several hang up calls on my answering machine? This agent is telling me that they will seek legal action against me. I get harassed offend. I expanded my finical situation to the agent but he implied I was lying.

- being harassed replies to MargaretGot call from an agent from this collection agency. I was asked to provide them with my bank account so that they could "work" with me on paying off a medical bill that my insurance didn't cover.
- Pro SeBeen there, done that too. The ONLY thing unscrupulous CA's (like these) are interested in is the WHOLE enchilada. Hardship letter? (the whole thing started after I was out of work for four months). NOT interested! Financial Statement and Debt Settlement Offer? FORGETTABOUTIT! Fortunately I saw it coming and was able to close my bank account before they sent me a rather official-looking letter, informing me they had "frozen" it.
Ummm....WHAT account?
I can't BEGIN to tell you the satisfaction I felt, as I fed their LAST piece of s*** through my shredder. When they found out, they began calling me EVERY hour (and, sometimes TWICE), on the hour. Well, I "NIPPED" that (as Barney Fife would say), too: I called my phone company, had my number disconnected and changed to an unlisted one. END of discussion. They had made their decision, and I had made mine. I had been beating my head against the wall with these Goons for over six months, trying to negotiate a settlement with them, and their response was to bury me in legal papers with the accusation: "You have REFUSED to pay!" What B.S.! Not ONCE did I EVER "refuse" to pay them or their so-called "clients", who basically turned DOWN a $18,000 PAYMENT. They CHOSE, instead, to sell the debt to these bottom feeders for pennies on the dollar, who began a relentless campaign of harassment, intimidation and attempted extortion. Well, they wound up getting NOTHING, and holding their you-know-what's in the wind.
Margaret, what has happened to you is a TRAVESTY, and indicative of how out of CONTROL the Debt Collection Industry has become. And, I don't see any end to it, unless OUR Federal Government overhauls the 31-year-old FDCPA laws. But, WHY should they, when the majority of our lawmakers are bankers and lawyers themselves? They eat caviar and belch platitudes about the need for debt collection reform....as the powerful ACA lobbyists pay them off, to do NOTHING. And, to Kristin and the others here who have given out their banking account information: CLOSE YOUR ACCOUNTS IMMEDIATELY. LOOK AT WHAT HAPPENED TO MARGARET AND WHAT ALMOST HAPPENED TO ME. THEY ARE NO MORE INTERESTED IN "WORKING" WITH US, THAN WE CAN FLY. THEY WILL DRAIN YOU DRY! - Chrissy| 1 replyI've heard alot of threats about these debt collectors garnishing wages and wiping your account clean. If you don't give them your accnt information, do they still have the ability to do so? If they do take legal matter as far as taking me to court, what will they get out of me if I don't have money at all? Lastly, if I file bankruptcy, will they still be able to call me or collect this debt?

- silly collection guysThank you Fogarty for your great post! Information is the real power here. The people calling you (like collection agent John Logan) are not lawyers. They are not financial advisers. Odds are they are uneducated, bullys who are getting commission to say whatever they want to get to your money- sounds almost like the exiled, rich, Nigerian Prince email scams that people get.
Do not let them bully you or yell at you. That is wholly inappropriate. If they were interested in conducting business in a professional manner, they would not act so unprofessional.
Each state has their own laws for helping patients pay their medical bill collections. It is for people with or without insurance. Basically- you usually only have to pay roughly 30% of the left over amount. Google the laws for your state. To make it worse for the collection agency--you can go streight to the medical provider and offer them even less and making payments-- then the collection agency gets nothing. You do not have go through the collection agency.
Do not give them any of your account information!!! Ever! If you already have, contact the agency and the bank in writing immediately and let them know that the account is not eligible for AFT (automatic funds transfer) etc, that the collection agency is doing this without your consent and that it must stop immediately. Depending on the bank (if you have never allowed the collection agency to withdraw funds but they did anyway) you can demand the bank reverse the fraudulent charges and credit your account. Then report the agency for wire fraud, misc fraud, etc.
As this is an unsecured debt, they are far behind other secured debts like auto loan or mortgage in the chain of command. Secured debts always get paid first and they know that.
Odds are that they have already reported this debt to the credit reporting agencies so it doesn't really help your credit score to pay off the debt anyway. But I am sure they will say it will- again, they are not lawyers or financial advisers.
If you do want to make the payment to them, Tell them to send you something in writing regarding your specific account that they are willing to "permanently delete" any credit reporting upon any payment before you will even discuss your account with them. Odds are that they will say that they can't do that, only their manager who is away from his office right now, can do that.
Basically, you have rights that they do not tell you about or want you to know about. If you know your rights, they can not bully you.
I hope this helps someone.- Caller: California Business Bureau

- ConfusedA woman from an "unavailable" number called and left a message saying this is Angela from California Business Bureau call me back at 800-755-1515 extension 260. She spoke very fast so I could hardly understand the message and left no details as to why she called. I returned the call, and asked the receptionist for Angela. When Angela picked up the phone I identified myself and she said, "Wrong number" and hung up on me. Suspicious of phishing or fraud I called back and told the receptionist that I want to be removed from any sales calls list or whatever kind of scam they are running there. I have never had any medical bills in my life. I think they got my information somehow and were trying to confirm that they have the phone number of a real person.

- JoelA guy named Andrew called on my cell (the number shows up as private/unknown on the caller ID), left a message with a name of a person to call him on his extension. Did not state what compnay or organization he is calling from. I googled the number "(800) 755-1515", and it came up with a few results. It is apparently a collection agency called California Business Bureau located in Monrovia, CA. They seem to specialize in collecting unpaid medical bills.

- Just MeToday I call a call from a guy named Anthony from California Business Bureau and they said they were trying to collect on a medical bill I had last year. Asked him to mail me all the information that is in reference to this matter so as of today he will be sending me the info but I'm thinking of contacting the hospital and see if they can work with me because from what I'm reading here I don't really want to deal with them. They don't sound very legit.
