I got really messed up with my Wachovia bank cards by listening to one of them tell me to miss a payment and then I would be eligible for their "Hardship Program".  I did this and marked it on my calendar for when to apply.  They called me on that day and then told me I was not eligible because the account was over the limit.  It was over the limit before I missed a payment.  They now take money out of my checking account and they call me at my place of employment every single day.  I want to join in if there is a lawsuit.  This is ridiculous and they should have to pay for what they have done to me and all the others posted on here.  I can no longer try to deal with them because they are liars and crooks.  Isn't it against the law to harrass someone at work?

Yes, it is illegal and they have to stop once you have informed them that you cannot take those calls at work.

We changed to Bank of America in large part because of them taking our money without asking.  I even had them take it from a separate account that was in my name only.  (The mortgage is in both my name and my husband's.)

The other reason we dropped them was because they let someone use an OUTDATED debit card number to hijack our account!  And then tne guy couldn't understand why we wanted to close it!  DUH!  What's the point of changing the number if the old one can still be used?

I've been receiving calls from this number for the past couple of months. At first I was receiving anywhere from 5-30 times a day. Sometimes I get a voice recording telling me to hold, sometimes the line is just silent and the call ends shortly after, and once in a while I get a person on the other line. Whenever I do answer and get a person on the line I inform them what time is convenient for me to accept calls regarding my debt and explain my situation. The responses vary from, "Well if you owe money its not about your convenience and you deserve to be called repeatedly and harrassed" to "I am sorry, the computer dials the numbers and unfortunately they will keep calling, all I can do it put it on a 48hr hold". They claim they are within FDCPA guidelines, but I have a hard time eating that bullet.

Here are a couple of sections in the Fair Debt Collection Practices Act (FDCPA)

§ 805. Communication in connection with debt collection         Title 15 US Code: 1692c

    (a) COMMUNICATION WITH THE CONSUMER GENER-
ALLY.  Without the prior consent of the consumer given
directly to the debt collector or the express permission of
a court of competent jurisdiction, a debt collector may not
communicate with a consumer in connection with the col-
    lection of any debt—

    (1)  at any unusual time or place or a time or place known or which should be known to be inconvenient to the consumer. In the absence of knowledge of circumstances to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is after 8 o’clock antimeridian and before 9 o’clock postmeridian, local time at the consumer’s location;

§ 806. Harassment or abuse                         Title 15 US Code: 1692d

A debt collector may not engage in any conduct the natu-
ral consequence of which is to harass, oppress, or abuse any
person in connection with the collection of a debt. Without
limiting the general application of the foregoing, the following
conduct is a violation of this section:

    (5)  Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number.

You can pull the full document up and download it if you google FDCPA and read more, but those two subsections sum up most of the issues I am having with the calls. The FDCPA does not specify what days they can call, so yes they can call on Saturday, Sunday, or even on holidays. Its very rude and just makes me want to not answer personally, but the law does not prohibit them from doing so. They can also call you at work. YES they can indeed call you at work UNLESS they KNOW that your work does not allow personal calls at work. That is stated in the FDCPA as well.

Solution... I dunno. From what I can tell from speaking with the wachovia agent on the phone, they will not or cannot update your profile with times at which you can be contacted. If you send a certified letter stating xx days/times are not acceptable times to call, I would think they would have to update the computer or face civil charges.

If anyone has had any luck with dealing with them please fill us in.
If anyone plans on filing a lawsuit or civil case, let us know!!!

My Mom got a call from this number today.  She's had a loan with Wachovia for nearly 5 years and done business with the same branch (although it's changed hands through various mergers) for over 30 years.  They called to say she's late on a payment.  They've called 6 times today harassing her about it.  She's within the grace period.  The same way she has been for the past nearly 5 years, i.e. she always makes her payment between the due date and the grace period.  Apparently now that requires a call from collections.  I'm livid with them.  Either there is or there is not a grace period.  Make up your mind.  They keep saying, oh but it's still late.  Sounds like they need to lay some people off if they're sitting around in collections with time to go after little old ladies who are within the grace period to pay the loan that they've paid the same way for this many years!  The last supervisor she spoke to tol her they would continue to call her until she paid it.  She pays in person, and the nearest branch is over half an hour away (she lives in a small town).  So, she has another day or two to listen to this before she goes to town.  This is ridiculous!  Pure harassment!  If this is the new Wachovia/Wells Fargo, I'll be looking for somewhere else to do business!

I closed my checking account after they decided to just take my funds.  I also get harrassed constantly and never go past my grace period with my morgage payment.  If you finally answer the phone and tell them you will be paying at the bank and what date, they still call you constantly after you tell talk with them,  absolutely nuts.  I cant wait to re-fi with another company.

I continue to get calls from 1-800-829-2474. I never answer and whoever is calling never leave a message. Upon googling this number I see that others are having this (or worse) experiences as well. I wish it would stop.

I also received a call two days ago at work from Wachovia Collections.  I'm guessing it's from this telephone number.  I don't have caller ID at work.  However, he told me that this phone number was listed as my home number.  I came into work this morning and there's a voicemail message that others have mentioned to call 800-829-2474.  The voicemail does tell me the calling number and it was 336-970-4221.  I am one payment behind on my mortgage.  I've received several calls since that first call where the phone is silent when I answer so I just hang up.  I guess it's them calling again...

These people are insane. They repeatedly call and then tell you "to hold please" if you answer (yes I've spoken to them in the past and I owe nothing to Wachovia). So far 8 calls today and it's only 12:30 pm. If this is Wachovia you need to be reminded why your company failed.

I receive calls from this number everyday starting at 8am and sometimes not ending until 9pm. I've counted up to 30 calls a day. I have no Business with them. It needs to stop!!! While posting this I received 2 calls and I answered both times and its a recording or no one there.

We get an average of 5 calls a day. Sometimes they are in quick succession or they are spread throughout the day. They call anywhere between 8am and 9pm. I answered and after a few moments of silence a man asked if my parents were home. As soon as I explained that they were out, he hung up without leaving any sort of message. They then called back 4 more times throughout the day. This is absolutely ridiculous. It became so irritating, we unplugged our home phone for a few hours. In that time they probably called about 20 more times.

I believe this is an automated call from Wachovia/Wells Fargo, or a collection agency calling on their behalf.  .
They put my line of credit on the wrong property
failed to cancel my line of credit
and then forced over 1,000.00 in insurance on me because my homeowner's insurance supposedly lapsed
(My homeowner's insurance has never lapsed so they had no legal right to force the insurance policy)
I provided them with documentation from my lawyer and insurance company.
I still get harrassing calls from three different numbers for unauthorized insurance on an account that they failed to cancel which they placed on the wrong property.  (I gave them PIN number and address of the correct property and they still screwed it up, and everything else I ever asked them to do.)
Still fighting it out with them.

I, too, get daily calls from this 8008292474 number and it is making my entire family insane!  They will never leavea message.  Shouldn't it be illegal for businesses to call and call and call and NEVER leave messages stating who they are and what they want???!!!???  I have all of my numbers on the "do not call list".  I've told them to stop calling our home!  My daughters and I have told them they have the wrong number; the person is dead; and every other excuse possible.  Still, every day, it calls at least 5 times!  It's sad, but I'm actually thinking of changing our number just to stop this ridiculousness!  That, in and of itself, is insane...that I would change our number, uprooting our entire lives in certain ways <<daughters go to 2 different schools with our number & changing it is not so easy! LOL>> instead of this so-called professional company (since everyone on here says it's Wachovia!) just NOT calling us anymore!

Is there anything I can do to stop this?  Thank you!

I've been reading a lot of these posts here about Wachovia and what some people are saying Wachovia did to them.  I'm sorry; I don't mean to seem rude or argumentative, but no bank (no business for that matter) can do what many people on here are saying they've had done to them!  It is quite 'over the top', not to mention illegal.  Let me put it like this...if even half of this stuff is even half true, LOL, boy have you guys got some lawsuits!  I hate how 'law suit crazy' America is, too, but what is being claimed here deserves a lawsuit!  IF IT IS TRUE...I have a checking and savings account with Wachovia/Wells Fargo and I find it far better than, say, BOA!  And I was with BOA for years!  BOA seems to only care about illegal aliens, so I moved on...Wachovia was not my first choice after BOA either.  Anyway...I just had to put my 2 cents in, not that it matters. Have a great day! <<oh, and if wachovia is the one calling my home over & over & not leaving a message, as discussed above, i won't have as high of an opinion as i just said i did.  that will change everything!>>

We had a prime equity line that was closed in 2007. All of a suddenly we got a statement with a charge for insurance for a property that we sold in 2007.  They are researching the error in the meantime we get calls from this number for collections.  Reported it to the FTC.
