- judy m replies to M| 1 replyin the first place it is a pay day loan and for which loan do you go to jail for when you do not pay it off i have been trying to pay one of these places and they just do not want to work with me so i just say take me to court at least we will get it resolved that is all i can do. they try to tell you that it is a bad check and it is not it is a loan.
- Elspeth replies to judy mDebt is civil, not criminal, so you cannot be arrested for defaulting on a loan. If they're threatening you with arrest and jail, this is a violation of federal law. Also, defaulting on a payday loan is *not* in any way, shape or form, check fraud. I would make sure they know you're recording them every time they call, keep a note of dates/times they call as well and what was said. A good consumer attorney would love to sue these jokers for you - and they'd end up paying you.
As well, per the FDCPA (Fair Debt Collection Practices Act) you should never pay any caller who refuses to mail - do not accept email or fax - proof of debt/proof your caller has the legal right to collect said debt. Refusal to mail this documentation is yet another violation of federal law. In other words, no written proof you owe them money - they can go pound sand, per the FDCPA. - TASHA replies to KatieDO NOT CALL THESE PEOPLE. THEY ARE SCAMMERS. THE NUMBER FOR 123 SETTLMENT HAS BEEN DISCONNECTED.

- Melissa replies to AlfalfaHas anyone been contacted by a private investigator stating that he has paperwork to file charges against them for check fraud? I called ace cash express and they gave me a number for debt management partners, but when I call them I only get an answering machine for "Karens desk". I've called several times and gotten the same "voicemail box" for this Karen person. I've contacted my local authorities and my attorney and they said that there has to be a judgement filed against me before any legal action or papers can be served on me. Do I take this as a scam, or should I be concerned?

- BigA replies to cindyNo one goes to jail because they ow money, went out over 2 centuries ago. No one gets notified or served over the phone. You have to be served in person by a court authorized person, or by certified, return receipt US mail.
This is a common ploy by criminals attempting to extort money from people by scaring you into believing that you will be criminally charged, go to jail, lose your driver’s license, have wages garnished, be sued, and a variety of other variations on this, all for an alleged or nonexistent debt. They also use the “process server” who calls and claims he is going to serve you, but then says you could avoid it by calling another number. Now why would a “process server” want to do you, a stranger, a favor, and at the same time not get paid to deliver the papers?
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

- JodyFirst of all you can not go to jail for owing a debt. However, if there is fraud involved that's another situation that could result in legal proceedings. Debt collectors have all different types of strategies to collect on old accounts. My experience has been with this particular company was, they left me a message from Midwest Recovery Systems, LLC but the number they gave was for Debt Management Partners. When I called I first was speaking with Greg, my phone died I then called back and was put through to Rich. I told Rich I was talking with Greg. Rich said he was a supervisor. I told him great I would prefer to talk with someone that was a bit more seasoned anyway. I played the game with him for a minute. However, when he told me I had taken out a payday loan in 2015 and defaulted on that loan on March 25, 2015 then he changed and said oh no it was June 18, 2015. At that moment he screw up with me. I told him I know for a fact I have not taken out any payday loans because if I needed funds I would go to a bank or bigger financial company to get funds. I told him yes I've had payday loans some 8 years ago and have paid them so what do want with me and my money now? The burden of proof is on them. He wanted me to go get a police report for fraud and I told him you haven't sent me any documentation showing that someone has taken out a loan in my name therefore, you want me to burn my gas and spend my time on something that I know not to be valid? I told him he was crazy. He said I will send you the information what's your email? I said H*********@live.com. While on the phone I check surely he sent the email. Which of course this would be what he considered the first contact with their "You have 30day to reply bluh bluh bluh. Little did he know I have debt collection letters from previous credit repair and I was much obliged to send to him which I did reply to his email with letter as an attachment. Haven't anything else from them. HOPES THIS HELPS!!!!

- CatSo glad I’m not the only one. I just took a call from some debt management company. He asked for last 4 of my social to assure he was speaking to right person. I cut him off and ask what this was in regards to, he kept repeating to give him last 4 of my social because of law policy he wasn’t able to release any info unless I give him those #’s. Not happening..
